Hey everyone, I’m wanting to get an answer and see what you fellows have to say on this situation? Can an owner operater / company owner not pay his drivers on corporations? Will the owner of the company / the owner operator get in trouble for it ? Or will the subcontractors get in trouble for it ? This is ridiculous! Rates should go up for owner op trucks , No owner operator can afford to pay on payroll when leased to a company ? Please give your insight

If you can't afford to pay right, just maybe your rates you are charging are too low

    No.
Unless they are free to drive for several other owner/operators and the driver’s core business is casual driving for several other owners.
They have been really cracking down on it in the last couple of years.
You will be fined and held responsible for the remittances that should have been submitted by you.

Government is going after driver inc companies big time with doing audits and giving out fines . If you are only allowed to work for one company and they set your start times, work schedule etc etc you are actually a an employee not a contractor and down the road if you lose your contract and work for the driver/contractor they could come after you for things like unpaid Ot,severance ,vacation pay etc etc as they were misclassified as a contractor when they were really a employee. I know Uber is being sued right now by a employment law firm because they were misclassifying employees as contractors and now the law firm going after them for things like unpaid over time ,vacation and paying a minimum wage

If a contractor only bills one customer, CRA will likely deem that contractor an employee. If they do that it opens a Source Deduction and GST Trust nightmare for both parties, and there’s only ever one winner in those. Not you. There are ways you can do it, but the Admin and Legal costs make it mostly pointless.

Seems folks think truckers the only bunch working for cash. Plenty of contractors(building, HVAC, mechanical, marine) work for cash, the worst effect I have seen of someone paying cash was for a inframe, engine puked 10K km down the road and NO WARRANTY.
