Due to a tragedy suffered on December 15th, 2009, my father, 62, is now a paraplegic for life. My parents are now both indigents as they owned a single semi truck which was their only means of living. My dad was the driver and my mother was a partner as the dispatcher for the sole proprietorship business.
My father stopped in Spokane WA after loading a large military vehicle from Fort Lewis in Tacoma WA. After eating his meal at the Petro truck stop, he exited the building to continue on with his route. He was loaded with a military vehicle to be delivered to a receiving base in GA. He was then to reload in GA and head north to his home in Dover OH for the Christmas holiday. He has yet to make it home. He had never in 40 years of my life missed a Christmas celebration. That was until this Christmas. As he was walking towards the location of his semi, the sidewalk had not been properly maintained causing him to slip on the unconditioned sidewalk. He broke his back instantly from the impact of the fall on ice-changing his life forever. He has no mobility from the waist down; Doctors say it would be a miracle if he ever gets the chance to move a toe
Please give me feedback negative and positive on who's negligence and liabilty responsibilites issues are the driver or the truck stops.
Not really looking for Legal advice, just checking in General if this is how most truck stops are maintained for the drivers....
Anyone had a bad experience with a truck stop and their maintenace of the grounds?

Clearly the truckstop was negligent . At the same time there is some responsibility on the driver's part to watch where he was walking . We need more info .
Was the entire sidewalk and area around it icy , forcing him to walk on ice or was it a small spot he could have walked around ?
Were there other reports of drivers falling ?
Had any salt already been put down or signs placed warning of ice ?
There are just too many factors that are unknown . -

No legal advice here,just how sorry I am that this has happened to your family! It could happen to any of us. I got appendicitis on the road and that was scary enough. I can't IMAGINE the horror your father is going through.

First of all, please accept my best wishes for you and your family.
I took a nasty spill last year, though it was in a NJ rest area. Just got a bit quick on my feet and landed squarely on my back. Key word "squarely", as it probably saved me from a serious injury.
Truckstops are dangerous places. Never seems to be enough staff to cover the needs. But if this was a standard sidewalk, I'd certainly contact an attorney. If it was, say, between trailers, the chances may not be as good. But you may have a case. And I'd say in general, yes...often walking conditions are not the best and the standard paths not the best maintained.
