Are you unable to read or what? The guidance and regulation both show this as wrong. Or are you just one that can't admit they are wrong?
A bad LEO doesn't a regulation make. If I get a citation I will attempt to get the supervisor involved. If I still get a citation the court will dismiss it as it's specifically stated non-required lights don't have to work right in the regulation.

I had in mind my 'favorite' scale.
Truckee CA. I've seen 3 hours inspection on a beautiful
custom made Yellow Pete 1 week old on his maiden voyage.

The supervisor will refuse to get involved or backed the inspector.
If the last hope is a court, in CA, I wouldn't hold my breath.
My reading skills are OK, so far.
My advise, based on years of dealing with their scales:
Fix everything that's installed and part of the truck as lightning is concerned.

It appears based on most of the responses here and from my own research that this particular light being out is not a violation. However, as with many other things, it is one of those things that could probably still get you a ticket depending on the LEO on duty that day, whether or not it could later be dismissed.
My personal belief is, it should be fixed anyway because although it is just an auxiliary light, it's still a brake light and thus should be working. Plus, any light being out is kind of like laying out the welcome mat for an inspection, IMO.
I was hoping to come up with an actual legal regulation to back up my opinion but for all intents and purposes there does not appear to be one.
