    Do you blame a tree or bridge support for being there if someone leaves the travel lane and strikes it?

    I agree, no one should park on the shoulder unless it’s an emergency and the vehicle isn’t capable of safely moving to an exit ramp or something ,
    But if a driver leaves the travel lane and strikes an object that’s NOT in the travel lane , that’s the drivers fault , it’s not the fault of the object that’s NOT in the travel lane .

    there’s plenty of roads with no shoulder at all.
    Everyone some driver runs off the road and hits a tree or rock or utility pole or fence or whatever , is that the fault of the driver who left the travel lane ? Or the fault of the tree or rock or utility pole or fence for being near the travel lane ?

    And if you ever do have to stop on the shoulder you should have the tail lights off and the flashers on . And a triangle out if you’re gonna be there more than a few minutes .

    all of this is covered in the CDL manual and test but todays new crop of drivers can barely speak English , they certainly can’t think logically and put out all the physical effort of flipping the hazard lights on .

    I've posted 10 times. I'll make it 11. The attorneys, or more importantly, the legal system, doesn't view it this way.

    The only question will be, should the parked trucker have been illegally parked at that location? The answer, of course is no.

    Will the trucker face negligent homicide charges. Quite possibly, yes.

    So, for the super truckers causing all the stir, questions, and crashe, I post again and again, don't do it.

    Consider risk /reward. When same idiot supertruckers are tailgating thru construction zones- has a risk reward been calculated? Obviously no.

    Take the i55/i80 shoulder wreck where there is an exit ramp before and after the crash. Also, there are 3 truckstops within 2 miles. Risk/reward would tell the idiot don't park on the shoulder or there may be a collision whereby the person splattered into back of trailer may not survive. 10% chance. Actually, luckily enough this one did. The previous 9 posts were all fatalities.

    Do you think that Parker would like to reconsider? He is now facing litigation, loss of job, loss of time etc...

    Don't park on shoulders! Risk/reward is so far out of balance its sad.

    The fence posts, signs, etc... are state protected. Drivers are not.

    The fence posts and signs don’t have multimillion dollar Insurance policies is the only reason the scum lawyers go after the disabled truck for money .
    Because it’s easy money . One good wreck and the lawyer gets a new Yacht or airplane or gets to add three more Porsches to the garage .

    I also think there is a presumption by people who think like that, that courts will give a pass to a driver who isn't paying attention as long as he hits a truck that's parked in the breakdown lane. I do not believe that is the case.

    No one is arguing with what you say the law is or what may happen, We are however pointing out that we do not agree with it. So because we don’t agree with something you think calling us supertruckers trying to intimidate or insult us into agreeing with you is appropriate?

    I question your ability to drive just based on your attitude! Most I have met that call others derogatory names like supertrucker have proven to be the worst drivers and cause more issues on the road than they realise. My guess is your one of them!
