Has anybody had this happen?

    Trucking Company fired a driver. They told him it was because their insurance company would not insure him due to inexperience. He's been driving for them over a year. Last week, during bad storms up in Ohio, his truck jack-knifed and tore up the sleeper. Now they want him to "quit" (of course, so he can't get unemployment). I think he should let them fire him. Any suggestions?

    first off is the company he is working for in the state he would collect unemployment?

    If not, he can not collect unemployment. Unemployment is only paid to the state of which the company resides, not the employee. Stinks to be me.

    I would think there is more to it than the insurance claim. I seriously doubt the insurance claim would matter if he has been driving with them for a year.

    He got fired because of the jack knifed,not inexperience.They do this all the time,thats why its always better to shut down ,in snow storms,have him check his DAC report .Its always better to leave and go elsewhere .

    This is not true... I worked for Shaffer and was hired through the Florida terminal about an hour from where I live. Crete took over and that's when things started going really bad with management. I had an accident where I was hit from behind and Crete labeled it as a preventable. Crete wanted me to go out with a trainer for two weeks as a precuation stating that I apparently needed extra training due to this accident. I disagreed and Crete said, "thank you for your resignation". I tried placing a claim for benefits here in Florida but I was told by the Florida Department of Labor that due to the fact that my paychecks came from Nebraska I had to file with the Nebraska Department of Labor. I has to go through a hearing becuase Crete claimed that I didn't follow company policy but the Labor department saw things differently. Due to the fact that Crete falsified what actually happened and refused to investigate the situation properly before passing judgement.

    I was awarded full unemployment compensation along with full COBRA benefits from the state of Nebraska and I live in Florida. You have to stand up for what is right because the more drivers that get mulled over by these larger corporations the more they're going to try to get away with it.

    Unemployment was paid! Federal law but to what state the employment was in. DONT give it up.

    This is to the person at Crete!NEVER is getting hit in the rear the driver in the fronts fault! I'll even tell this to your face! Even to the IDIOT CEO of that Bottom Feeder company!

    Driver: The next time some office desk jockey tells you after you got hit in the rear it's your fault, ask him ONE simple question, ARE YOU ### NUTS? THEN get the fool to explain to you the SIMPLE rules for following the vehicle in front of you!

    BUT NEVER lay down to a BOTTOM FEEDER like CRETE that refuses to pay you just unemployment! What a bunch of penny pincers when they KNOW hey asre wrong! What are they teaching these idiots in college these days?


    Me I'd be talking law siut for tons of money to teach them a lesson! Hardship false reporting to DAC and just stupidity!

    some states have reciprocity, you go in and file for unemployment where you live, and one state contacts the other to charge them (and the employer) for the amount, but you are paid based on the local rules where you live.

    Threats with-out action are meaningless.
    I am not intimidated by "threats" because I know that they are seldom carried thru.
    I am sure companies feel the same.
    If you want action, don't waste your time with a "threat", just take action.

    I have never "threatened" companies three times, but I am successful in taking action against three companies.

    See how that works?

    I agree with the threat issue. Never waist your time threatening anyone for (if any) reason, you are giving them a chance to prepare and the best way to combat an enemy (or in this case an enema), is to take them off guard... walk away as if you have no intentions of any retribution and then go after them strong.

    I am not someone who would waist my time in suing anyone unless of course it was over wrongful death or injury. I would rather spend my time in productively investing that time in myself so I never have to return to the immoral unjust ways of trucking.

    I'm a bit of a philosophical soul... in the old testament ("But his wife looked back behind him, and she became a pillar of salt.") - Genesis 19:14-17, 23-26, NKJV. Mrs. Lot stopped running to gaze at the destruction of the city. As she stood transfixed, most commentators agree some of the molten sulphur ("brimstone" verses 24) likely rained down on her, and crystallized her into a pillar. This is what Lot would have seen when he glanced back.

    As documentation translates throughout thousands of years, society believes that remorse took over and this is what caused Lot's wife to become bitter.
