    Folks, the DAC entry is not a lie and it is not in error. The OP admits he did not go take the test. In life, you can't just get things removed from databases just because you don't like them. With that said, however, it is a free country and you have nothing to lose by trying. Here is a LINK to the instructions on how to challenge things placed in DAC.     This is a recruiter doing what they do. They think because they spent 15 minutes a couple of times talking to you on the phone that they’re entitled to ruin your life because you didn’t fall for their bag of tricks and go work for them. If it were me? I can tell you how I would handle it. I would gather all the evidence and I would go find myself a nasty pitbull of an attorney and I’d go take that recruiters lunch money.

    You are correct, But I was never an employee of the company either.

    Seems there are people on both sides of the fence that say because I never worked for them it can be removed.

    Some places I have read say because I never showed up to the drug testing facility, the company will need to show proof I showed up. Otherwise if they cant it gets removed.

    I dont know what the ### to believe, its all smoke and mirriors.

    You have a right to dispute with DAC/Hire Right the accuracy of the entry on your file.

    You also have a right to have a brief statement of your distributed by DAC to anyone making an inquiry about you. Go read the FAQs at Dacs website about the format and length of your statement. If you submit a statement that is too long your statement will not be distributed. I would think a short & sweet "I was never hired and never worked for this company." Would be sufficient.

    The same rules apply to DAC / Hire Right as credit bureaus. You are entitled to AT LEAST one free copy of your report per year, right to challenge any entry, write to submit statement, etc. Look up Fair Debt Credit Report Act, IIRC.

    Read the regulations. It's your career you should find the time. I rely on Zvar and Moose1958 for lots of regulation reality-checks. But the regulations are the final authority.

    You might dispute it.
    If it's a mega. They might not verify given the amount of turnover they have.

    As a side note. Companies that use dac usually aren't worth working for anyways. Usually. And number only few. There are tons of companies that don't use dac.
    And could care less for dac.

    Work for them instead and life goes on.

    Wow, reading this thread reminds me of the petty BS placed on my DAC report many years ago... and how it affected my chances with prospective employers. Probably why I gravitated toward smaller outfits that didn't bother with DAC... if you showed up at the yard or office, were clean-cut and didn't look like some tweekin' crackerhead, and you passed a road & drug test no problem, you were in, lol. Oh, yeah, having a clean MVR also helped, lol... ;)

    P.S. I once had a "satcomm violation" listed by a mega carrier for sending a message to the owner and telling him to f*** off, lol. Not a model employee in that respect... :rolleyes:

    When it comes to that pre-employment drug test YOU DO NOT HAVE TO BE AN EMPLOYEE. This is one of those rare situations where I am going to basically agree with the above post about a carrier not using DAC. Because you were not an employee and did not attend orientation you DO NOT have to list this carrier on your application. A carrier that doesn't use DAC will never know about his. BEWARE though, many carriers that normally don't use DAC have been known to order an ad hoc DAC report from time to time.

    A very good friend is the head of safety for a 200-unit carrier based out of a state in the midwest. This carrier according to him generally does not use DAC. He and I have talked about this many times. What he told me was if the driver can verify his time and we can get confirmations from the old employers they don't worry about DAC, will send them in for a pre-employment drug test and when negative put them in a unit and to work. If they can't get confirmations or see something hinky then they will buy an ad hoc DAC report before round-filing the application.

    Always go to a scheduled company-paid drug test. Think of it like free practice. Fake it till you make it. Practice makes perfect ;)
