I would like a professional opinion from a freightliner certified mechanic. I recently drove a freightliner for a "former friend" of mine. We were running teams in his apx. 1999 or 2000 freightliner. I advised him that the truck wasn't running right. It seemed to be lacking power all of a sudden. It seemed to be errattic. He drove another shift, and said all the shops he stopped at weren't able to fix it. When I woke up he was at a shop. I started my shift while the truck was in the shop. The owner operator told the shop I was "more mechanically inclined". I told them I thought it was either the turbo, fuel filters,or injector. Later, the shop determined it was a leaking fuel selenoid, which they advised was repaired/ replaced. Apx. 200 miles later the truck starts knocking and shuts off. I pulled over set out my triangles and called the original shop to see if they had a local shop in the area. The owner operator got on the phone with them and told them he was a former cop and knew about liability and would sue them.The truck was towed to a shop then another shop.
The problem is the bill ended up be an alledged $7000.00 now the owner operator is threatening to damage my dac driving report and sue me for $7000.00. He said some engineer told him it was my fault and an injector went out and by me alledgedly continueing to drive it caused the other injectors to go out. I think this is far-fetched, and I did everything I possibly could do take care of his truck. I advised him of the problem, babysat truck at the shop, and didn't try to keep driving the truck....when it shut off I called the first shop. The owner has a history of sueing and threatening sue people. Everyone I have spoken with seems to thinkthis is bs as well. I was advised injectors are electrical and go out. The truckhas over 700,000 miles on it. I would like a personal opinion from a Freightliner mechanic if I'm not the only one that thinks this sounds far fetched. As a team the owner/operator was in the truck with me. I was the one who advised him it seemed to not be running right as a driver not a mechanic. And to make matters worse he only paid me $250.00 to greyhound home. I drove over 3000 miles solo the previous week and most of the driving as a "Team". I realized I wasn't going to get paid and he wanted me to sit at the shops for 3 days for free. Plus, I had to tend to some personal business at home. He paid me under $350.00 total, threatening to damage my dac and sue for $7000.00. Any diesel mechanics help me out?
Anyone else think this is bs?? He was in the truck with me. The shop said the truck was fixed. After the fuel selenoid it ran better till apx. 200 miles. I have over 8 years experience as a cdl driver.
Any diesel mechanics????

GIXXER good morning to you. now first let me say im not certified in anything except on occasion having a big mouth , hell at least im honest.
i just read your post and it sounds to me like the fellow you worked for is trying to blow smoke up your but. driving for him makes you an employee and you are not responsibe for the mechanical failure of his equipment in perticular the internal workings of an engine after all he hired you as a driver not a mechanic.
now it is true he can sue you if he is so enclined but anybody can sue for any reason but that dosent mean they can win and in your case there is no doubt they would lose. it takes all kinds to make it in this world and most of the bad you will find in the trucking business but they dont last long .
now as far as DAC is concearned i cant tell you i just dont pay any attention to them and i dont deal with anyone that does there like a credit reporting agency , in my humbel opionion THEY SUCK and not a lot you can do about them except sue and that cost money, thats why they get away wth the things they do most divers cant afford to fight then , but in any case i would just ignore the guy in most cases the bad just goes away.

I doubt seriously if he even reports to DAC. Considering the whole membership thing, and it's cost. -
from what you say when an engine knocks and shuts off as you described it means an injector tip broke off ... it happens in less than a minute so i don't know how a mechanical failure like this could be your fault . as to the cost seems high to me sometimes they can get the piece out without removing the head sometimes the head needs to be removed and occasionaly the head is damaged and needs to be replaced. $7000 seems to be double what replacing the head should cost as far as the other injectors thats on him they should have only had to replace the one that failed
sounds to me like the shop that replaced the fuel solenoid mis-diagnosed the problem
as far as your "buddy" tell him where he can put his injector and wipe up with the bill -
I am a licensed tech. As far as Freightliner goes, I have worked on many. I actually work at an International dealer. Chances are your truck has a Cummins N14 or Detroit Series 60, or a CAT, all of which I have worked on many times as well. First of all, a 99 isn't a new truck. The age alone should get you off the hook. A truck that is 12 years old will be more prone to breaking down compared to one that is only a few years old. As far as the second break down, it could be due to the first repair. I would need to know exactly what they did in both repairs to give you a better answer. If you had a leaking fuel solenoid in the first repair I am guessing that was the root cause to everything. The injector solenoids are under the rocker covers and part of the injectors. If one was leaking fuel, it would leak fuel into the engine. Fuel would leak into the oil and actually mix with the oil. The fuel would dilute the oil and reduce it's effectiveness to properly lubricate the engine. If this was the case by the time it was repaired the damage was already done. Who knows how long it was going on, before you noticed, I say not your fault. If the shop repaired the injector, but didn't change the oil and filter and that led to the second failure then that is the shops fault, not yours. For the owner to be successful at suing you he would have to prove, beyond reasonable doubt, that you deliberately ruined the engine. The only to prove that is to download the ECM and see if there are any low oil pressure codes, high coolant temperature codes, or low coolant codes right before the engine failed. He would have to prove that you knew it and continued to drive, I say hard to prove. If the failure is sudden and catastrophic there is nothing you can do. I very highly doubt he would be able to prove anything in court, then you can counter sue for defamation of character and loss wages. But before I say anymore I really need to know exactly what happened each time to say for sure.

He's threatening to damage my dac report. We didn't get to a shop until over 10 hours later after me teling him there was a problem. He said all the shops weren't able or open to work on it.
His exact words are "when we was at shop(removed shop name or exact location of shop) you took the duty after vehicl maintaince, so it was up to you to verify the repair was full and complete, and no other work was nessary, which it was...so everything from that point is on you, i explained everything to my legal rep. and was told that i was correct it's own you totaly." and "well i gotta go and deal with truck/business issues as the repair bills exceed 7,000.00 dollars, and the engineers siad it was a result you you continuing to drive the 150 miles plus till it blew off all the injectors...and caused additional damage, so I gotta work on money issues and get a legal notification sent out to you by law, so i'll see ya later, it's just business, not at all personal."
First shop repaired fuel selenoid. Truck seemed fixed then all of a sudden sounds like it's knocking and shuts off. Truck towed to shop....we are at motel then I greyhoind home and truck towed to another shop. First bill a few hundred...and nest bill few thousand. I guess 3rd shop charged 7000.00 to replace all injectors....or maybe 7000.00 is total of all the bills.
I don't know. I know it was a cummins. Personally, I think he can't afford to pay me or afford the truck repairs so he's looking for an easy way out.Last edited: Mar 1, 2010

He said he was going to pay me as an IC on a 1099. Technically, he wouldn't be my boss. He did bark orders like a boss,though. He had all these electronics and all the wires were in a ball. He asked me to make it look professional and said he would pay me....but didn't pay me. I wish I had taken a before pic....u would lol. He told me where to store bills, when to take trash out, check the oil, check the water, don't bump the idle. I explained to him bumping the idle was good for the truck to raise the oil pressure and better lube the truck. He told me the last o/o told him that bumping the idle was a myth. And that companies only had drivers do it b/c the truck would shut off, if you didn't bump the idle.

if he doesn't pay you..... tell him you burn him by filing form ss-8 and open a can of worms for him with the irs and advise the irs you were hired as an employee driving his truck under his direction and did not know it was 1099 then he will have to pay unemployment, social security,and fica tax , and you minus the normal tax and then the irs will audit his business practices
and the state could come after him for not paying workers comp.......in pa the fine is $500.00 a day per employee for failing to pay workers comp
i doubt he wants that over $350.00

Not going to lie....but I believe the same results will happen if he misclassifies me...meaning IRS will fine and/or go after him for proper taxes.
