Can I be charged for a load that I did not agree to pick up?

Tell them that in light of the circumstances, you think you may be misclassified as a contractor instead of employee and would like to ask the IRS for a ruling. See if that changes their mind.

Just take the truck back do as everyone has suggested and just leave..

Why in the name of all the various gods saints devils and angles would you do ANYTHING without a #### contract? That business 101. And if your an employee then there needs to be a #### worker agreement and if there is not one why the hell are you working there?

I've already decided to leave the company. I refuse to be mistreated, threatened, pressured, harassed or degraded. I just wanted to know if it's legal. I was under the impression that It was legal to be classified as an independent contractor and 1099'd as a truck driver. After reading the responses, I see now that it's not legal. I guess I have some learning to do.

I'm a rookie I was under the impression that truck drivers could be 1099 and classified as an independent contractor. Boy was I wrong. Stupid of me. And yes I should have looked into it further. My mistake. Lesson learned.PaulMinternational, dwells40, Siinman and 2 others Thank this.

Id leave a little tip to the IRS behind too. If they are doing illegal crap like that and having people work for them without even a worker agreement gods forbid a contract....well you dont want them showing up at YOUR door. Also make sure to report on every single dime, wooden nickle, and bent penny they paid you. I've done some research. I have to file a IRS SS-8 form. It's a determination of employment. Independent contractor or employee. I have to proceed to file a complaint with Dept of labor and wage. Call OOIDA they can recomend a good tax person, lawyer and/or accoutant well versed in trucking if you need one. OOIDA dispite any othet arguments for or against are quite good at that kinda thing.dwells40, Constant Learner, Siinman and 1 other person Thank this.
