What Time Is It? Its Time For Question Of The Day.

    That's the answer the courts would take. There may be no right or wrong answer for us but there is for the courts. You don't endanger others to let someone merge when it's their responsibility to merge onto the highway. I know of a civil case that the driver lost because he was being nice and slowed down to let someone in and it caused an accident. You can tap the brakes and I most likely would but I didn't have those problems since I was in a large tanker with gasoline on. All you can do is the best you can do.

    Kind of funny i had this scenario happen just yesterday as I was merging from the on ramp. I was coming down the on ramp and there was a truck in the left lane behind a bunch of cars and they were passing a slower truck in the right lane. The truck in the right lane and I met basically even at the starting point for me to merge over in to traffic. However as I traveled down the on ramp I saw the traffic to his side and simply let out of the throttle to let them all pass by me with no issue so i could merge. The driver in right lane was kind enough to tell me on the cb that he could not move over but I already knew that because I WAS PAYING ATTENTION! I've always said it anyway that if i can move over I will but ultimately it is the person merging into traffics responsibilty to safely merge with the flow of traffic not the reverse as some people out here seem to think.

    Well we have all been in both positions. I have been merging on many times when a big truck could not get over and I just back off. It's called being aware of everything around you!
    And on the other hand, I have been moving along in the right lane when Mr. Big Truck is trying to merge on and I have had to almost come to a stop because he wouldn't back off...He's not aware of everything around him.
    Now, I am not gonna get in a big old accident just because I have the right of way. I'm way too pretty to have that happen!

    I wouldnt do a thing but tap my brakes..so the driver behind me see's them.. the driver merging is the one who needs to back off.. he has to yield to traffic..or ride the burm.. sorry .. driver I couldnt get over.. I would have if i could..now ya better start watching where you are driving..next time there might be concrete barriers :)

    Soon as your tires cross that line to merge, You Are Liable... Hold Your Ground in a situation like this... If you possibly can... anyone behind you or merging is at fault if a situation occurs. Sorry, its the law. (Period)
