Do they pull medical records like doctor visits during dot physical

    Yeah but here is the thing, the company can't be held liable for any disclosure under HIPAA because it does not apply to non-medical entities.

    I really was not attempting to imply that.

    A person in the US has 100% right to keep their medical information private. This also includes truckers. There are a lot of people in these forums (AND OTHERS) that keep pushing the narrative a trucker can use HIPAA to bypass the rules. YOU CAN"T! Once a carrier asks for relevant medical information as a condition of your employment you must either directly provide that information or sign a release. There are no if, ands, or buts about it. When a driver does provide that information or sign a release they are deemed to have given up their rights under HIPAA as it relates to that carrier.

    The same thing applies to a Medical Examiner. If such a medical Examiner have cause the medical applicant has to either provide the information or walk away with no physical. It really is that simple.

    I agreed I am just extending your point that the laws don't go beyond medical professionals, there is no privacy under HIPAA. Many people think there is but it is beyond the scope of the law.

    This may have been mentioned cause I didn’t read every post.
    If you get your DOT within the same Medical business… they do have access to your record. Sometimes it’s good, sometimes it’s bad… especially if you’re hiding something. I go to a Duke Primary Care for my med stuff… then I go to a Duke Urgent Care for my DOT. They absolutely look at my records for my DOT… I have a CPAP and they can see my data from my doctors office. They mentioned it. It can help that you don’t need to track down records to share if they need clarification. But if you’re hiding something, don’t go to affiliated places!!

    Reviving this old thread.

    Let's say they have reason to deny your medical. And operating commercial vehicles.

    Do they keep your license and prevent you from driving your car, too?

    Technically yes but class D medicals are way easier to pass.

    In my case, they did. I am a very extreme case, though. After my Epilepsy diagnosis, I lost all my driving privileges. I was told not even to attempt to operate a power scooter. As a general rule, at least in the USA, you do not need a medical to operate a non-CMV.
