    The only way something can be on your DAC report is if a cpmpany forwards the info they found like driving record crimal history ect...

    I've worked for mostly small companies for the fifteen years I've had my c.d.l. I don't have any felonies, but that doesn't matter, the point I want to make is many of these small companies don't use DAC, or do criminal background checks. I've gotten some of my jobs with just a phone call to a local trucking company listed in the phone book. The majority of the job's I've had have been otr. Don't give up, call those companies in the phone book.

    If he gets it expunged or annulled, it's up to the individual state he's in as to how it's listed (or not). Every library has state statutes that can be researched to find out the requirements and conditions under which an annulment can be granted. Better even to consult a criminal lawyer.

    In general, expunging a felony record of conviction should wipe out any and all records of arrest, trial, conviction, prison time, etc. to the "public", meaning, that unless he gets another felony conviction or applies for a "government" job requiring a high-level security clearance, it shouldn't show up. He should be able to pull an MVR and/ or a state criminal records check and come up clean. Bear in mind that it probably won't happen immediately.
    As for DAC, they just report whatever gets fed to them, right, wrong or otherwise. Every driver should check their DAC yearly (it's free once a year with some agencies) because, like a standard consumer credit report it can and probably will contain errors.

    Hope this helps. Previous advice on this thread is probably the way to go until solutions to felony record annulment can be found.

    umm i have a felony and i worked for maverick trans..they checked my dac and i lied about my felony. they never fired me, i quit. if i would have told them about the felony i never would have been hired. on the other hand, i have lied about it befor and worked 2 days and got fired cuz of it. it all just depends on who you apply with. hek apply with them..they wont look or dont care one. i say check no and work cuz you know when your on the phone with a recruiter and you say felony/drugs lol their whole attitude changes like you just told them you slept with their wife or somethin and hang up.

    JRide, your history is your history. How you deal with it defines you tomorrow. Do the research and try to get rid of the record. If you can't get rid of it due to it's nature, then re-evaluate your game plan.

    That being said, unless you can expunge the thing it will get increasingly difficult to acquire driving jobs unless you're an illegal immigrant.

    DAC is not used universally nor is it accurate a lot of the time. Treat it like a credit report and fix it so you don't get blindsided by errors. This is just a quick way to pre-screen the real undesirables before the company you apply to invests more time checking you out.

    Any driving job involving HAZ-MAT and/ or port of entry access like container yards or fuel depots are requiring TWIC which involves a background check with fingerprints and NCIC. This will pick up any un-expunged records, and may include expunged records since it's a federal agency and also because the reporting state may not be as complete scrubbing the files as it should. Bunch of factors, there.

    Driving jobs for subs hauling mail or other gov't materials may require s or e-86 form filing which is potentially forensic background checking. Don't even think of lying on that one!

    Previous advice hauling for mom&pops is the best way to stay off the grid but be aware that the insurance companies are getting a lot of pull in who drives and who doesn't. The company you apply to may seem perfect until the insurance company gets involved. I don't have experience as an o/o so I can't comment on whether or not having your own truck and leasing on with a broker is any "easier" in terms of reporting (or not) a felony conviction. The insurance company that underwrites you as an o/o may still have that power over you. Any o/o's out there willing to comment?

    Darkstar, do you know that for sure? I'm constantly amazed at how stringent hiring practices are becoming. Let us know if you have personal experience with these carriers regarding the hiring of ex-cons.

    I'm unsure about whether to close this thread or not, I don't see any reply posts from the original post(er)...Help Admin? Darkstar can keep it going for now if he has anything else to contribute.

    Otherwise, I'm looking for a real-world way to find out about Canada admitting US drivers with DUI's on their MVR's. I know a driver who has an aggravated DUI from 2002, got the license back 2003. The way I understand it, after 10 years from the completion of the sentence, Canada may deem the driver "rehabilitated" but it sounds like the border guys have carte-blanche to do what they want. May have the guy pay the one-time pass fee or throw him in jail and impound the truck...Even if the driver applies for a Minister's Pardon or whatever it's called and pays the thousand clams (and waits a year or so to get the Pardon), the border agents can still hold him up...Need real facts on this one. I see way too many different theories on the boards, understanding that the subject may be a tough one to nail down a solution on.

    Suggestions on the appropriate thread for this that's not totally convoluted?
