I don't disagree with your comment at all and understand your point which is extremely valid.
I greatly appreciate your input.
At this point, I have absolutely no infractions or points on my license as of now.
Q: Alleged misconduct of cell phone use? What do you think?

You are right, it absolutely could be (or could have been).
They did this to another driver several months later by placing reckless driving on the driver's record (so I was told by the driver).Last edited: Aug 8, 2024

I maybe the only one, but it is tiring to hear a situation where the driver is all upset about being dinged or canned, blame the company and then find out there is a hell of a lot more to the story which in many cases shifts the blame to the driver and their punishement or termination was justified.
See you are at fault, you compounded the problem by not willing to work with the company, they didn't single you out because of anything but your infraction of the rules, common sense rules that we all have to live by. Their insurance will go up if there was a ticket, their job is to make sure that they don't get in a situaiton where your actions result in lost revenue and being tagged for increases in insurance and state scrutiny. You justified or tried to by posting the FMCSA regs, but got to tell you that's just a cop out. The same with the cameras, you stand firm on it, acting like it is an insult to your professionalism (lack of a better word) and then act like you didn't do a thing wrong.
Now I allow some latitude with drivers but when it comes down to it, as my driver, I would not have given you a chance, I would have saw the video, asked you about it and if I felt you lied, you would have been out the door. But if you said "I made a mistake" and tell me what you do to prevent it from happening again, then I would have said "you know we are all in this together and we need to keep those vultures off our ******, so next time it is the door." -
I wanted to focus on the alleged misconduct and violation of company policy.
I simply posted FMCSA rules on using touch for a single button as the company policy - just describing how the company adheres to FMCSA policy as well.
I respect how you would have handled the situation.
Thank you for your valuable feedback.Last edited: Aug 8, 2024

Siinman Thanks this.

I'm sorry for your problems, but have a question.
Why would you not bow out gracefully instead of being terminated?
You say they gave you that option, but you declined.
Just my opinion, but would that not have been the better outcome?tscottme Thanks this. -
I have never had this happen to me.
I have no infractions or reports on my driving report as of now.
The driver said the company placed reckless driving on report.
To be honest, I am not sure.Last edited: Aug 8, 2024

I appreciate your input. -
Are we rehashing the same incident you first brought up in your first ever post on this forum in August 2023?
gentleroger and Bonita Nut Thank this. -
So the date/time that you had the phone in your hand will not show any call/text/email or any other use at that time?
You were caught red handed (LOL) and now complain, talk legal action.Siinman and Bonita Nut Thank this.
