This could work. Send a ping on the GPS to dispatch when you are right outside the shipper. Hold off until payment goes through, THEN proceed into the reciever. I'll take a stab and answer for the OP here.....he wants freedom, big money. He also wants a company that has no regard for HOS rules. They'll willingly edit the elog. I have a buddy that works at Orozco . They gave him the option of 1099 or W2 ; he chose 1099 for his own reasons .
The only negative he’s mentioned is the escrow they hold when you first get hired (like most of this Chicago companies) but otherwise he makes good money and gets left alone -
…… Another good one is TVA Logistics . They let you choose 1099 or W2 , used to have a $2000 per week minimum guarantee but they'll run you hard , you can make more if you’re motivated

I have to respectfully disagree. Being a small business under contract to work for a larger business is an important part of our economic system. There are millions of small businesses whom provide goods and services for a larger entity under a 1099. That's not to say that the contractor can't get burned, as it puts most of the risk on them to get the job done. If things don't work out, that's the brakes. If you are a wise business person, you know how to minimize the risk and manage the work so that it gets done properly and in a timely manor, all the while you are turning a profit.
The 1099 is not a way to cheat the IRS, it just gives more responsibility to the contractor. Unfortunately, shady companies have found that they can make all of the profit from a 1099 contract truck driver, with very little risk to themselves. They hedge their bets, if you will, with legalities like, escrow and other contractual obligations. Then some poor sap driver, unsuspecting, happily signs on, and here we are.

Not the same.
A Contractor provides the tools required for the job, he doesn't use the company's tools or rent the tool from the company.
There's a 3-part test:
All the parts in bold fail the 3-part test the moment the company has any say in the operation of their truck (where to park, PC, where to fuel, passengers, forced dispatch, etc.), how and when the driver is paid, and as simple as using the company's truck instead of one provided by the driver.Last edited: Aug 26, 2024
