Fragile Fuel Pump @ Petro Racine, WI

    Most recent update: I had to acquire the police report for this incident because the trucking company I was working for while the incident occurred has reported to the State of Wisconsin, in a legally binding statement, that I vandalized this fuel pump.

    This is despite the fact that the police report very clearly states, explicitly, that I did not do any such thing that could be characterized or even mischaracterized as vandalism. I believe this to be grounds to potentially take legal action against the trucking company for libel, defamation, or at least to issue a cease and desist order against them. I came to find out that they reported at least six things on the record, most of which I can easily refute with correspondence records that I have with the trucking company manager that reported such information to the state.

    I truly thought that I had left employment with that trucking company on amicable terms because I had to help my father who recently had a stroke and they were made abundantly clear of the fact of why I left employment with them.

    They reported that crap on your DAC report Blagoje?

    I don't know of any other "report" that would remotely matter let alone what you mean by a legally binding statement.

    Thankfully the company you worked for cant usurp the legal process because they didn't like you.

    Please clarify report and what was submitted to Wisconsin as a legally binding statement.

    I filed for unemployment with the State of Wisconsin and they informed me of what this trucking company stated as "violations of company policy" I surmise to get out of paying unemployment. They do have one thing that is legitimate and will stick as far as their company goes but frankly it does not impact me whatsoever, the five other "violations" are verifiably untrue and I have the documentation to support that.

    My concern is that if they're willing to report this to get out of paying for an unemployment claim I would be concerned that they would report things of this nature on whatever driving record reporting to damage my ability to obtain employment elsewhere. I am interviewing this week and next for local jobs in my current city of residence that I'm very confident that I will get so this might be a dead issue that I will not have to worry about.

    Nevertheless I did speak to a representative from the State of Wisconsin about obtaining these documented statements through a subpoena and they told me that I would simply need to send in a formal request and they can be released to me. I might just do that if I would need to clear my name and my record as well as sue for damages.

    Blagoje, good luck to you in whatever new endeavors! I say look for a tanker/milk hauling outfit by you. I delivered to many production plants up your way with my favorite being Gibbsville Cheese in Sheboygan Falls. I certainly wouldn't use them as a reference but would be upfront with a new employer using neutral language on why you weren't a good fit at that company, ie make the new employer read between the lines.

    Time to "lawyer-up". First thing Monday, you need to find a good transportation lawyer, and prepare to file a lawsuit. Also, file a challenge with Unemployment first, get that settled, THEN sue.
