Point blank either comply with the 391.11 regulation or you’re not gonna be allowed to drive a commercial motor vehicle… It’s pretty plain and simple…

Now that we have indeed established that the constitution and bill of rights does indeed apply to the FMCSA (see above video of someone using the 5th amendment to not submit to a FMCSA truck inspection) I will answer your question, which you wont agree with, but I have already said wait and see what the courts do with it. So please, dont even bother to respond to it, I wont answer. Just like I am not going to address the other court issues that I have already said we are not going to agree on.

Why the 1st amendment effects 391.11. Since there is no established uniform national language in the United States, the 1st amendment protects the speech of every citizen, regardless of what language they use. English-Only Laws

Without a constitutional amendment declaring english as the national language, it isnt proper that the government force states that do not recognize english as the only official language of their state to recognize it as such. As you pointed out in your CARBs spiel, someone from a state that does not recognize english as the official language of their state is being penalized by those that do. Until english is ratified as a constitutional amendment it violates article IV section 2 clause 1. As I have said, it will likely be resolved by the court. And I have already made my prediction that it will end by Aug 1.

And this is the last Im going to say to you on it, because as I have said, you and I will never agree on the status of the court. So we shall wait and see.

I think it is a good idea for drivers to be able to speak english. They do it for FAA pilots 14 CFR § 61.103(c) so they should do it for truck drivers.

Never heard that one before. Either way, Pulaski didn't speak English.

Airline pilots fly globally. Because they travel the globe and never know from 1 day to the next what country they would be in, from a practical sense, they HAD to pick 1 language. ALL airline pilots and air traffic controllers have to communicate in english. It isnt just a USA rule. It is world wide. They decided on english because the Wright Brothers were Americans.

Now I agree also, it IS a good idea that all drivers (not just CDL holders) communicate in english. I am not arguing that point. But until english is ratified as the national language of the US, it is against the constitution to make it so. IMHO at least.

Yeah, I watched some documentary about it. Who knows, but he/she was not American. But it’s debatable if anyone was American at that point. They probably considered themselves British.

Pulaski died fighting for American independence. That makes him as American as anyone else at the time. I'd also argue that most of the colonists fighting for independence would consider themselves "New Yorkers" or "Virginians".

Last statement was very true. All the way up until the civil war this was the common thinking. As far as Pulaski, idk. He/she was more a soldier of fortune. But not to diminish the impact that he had on American independence and pretty much the father of the American Calvary

That’s been on the books from what it looks like since 1970 so it’s not like they just put it in place… Sorry to rain on your parade, but the courts are not gonna do anything with it
