Need some advice please. Who should be playing driver or owner of the company. The driver gets stuck in Laramie, Wy summit during daylight in a snow storm (not very bad snow storm chain law was not up). The truck was not properly equip with chains they were broken. Tow truck was called in then had to chain up his tow truck and pull us up to get moving again and then charged a bunch of money. Can someone answer this please.

The Owner. However it is a common pratice in this business to try and make the driver pay for his mistakes.
-
Could the driver blame the company because of broken chains? The chains alone would get driver out of a big tow truck bill.
-
No but if I were you I would either quit in which case you will not be paid if you have any money coming or work out a payment plan if you like your job.
The payment plan say 100 bucks per check will provide job security. -
By law they cannot legaly charge you ( company driver ) for anything. Yes it might be your fault but it's against the law. But it does happen.
-
well they are already charging me, they are holding 2checks from me and just got a new check . They are deducting $200 dollars per check + im being taxed more then i should because its taxed gross then minus $200.00. What can i do now get a lawyer?

Hmmmmm.......Seems like you need have an "anonymous call" placed to DOT... from a "concerned" citizen....
There has to be several violations......... -
"Working Class patriot" is that against me or with me? How will reporting to the DOT help me? I told the Wyoming HWP "yeah we got chains, but its broken". No report was taken this happened on 3.23.10.

That's against the carrier....
Those rigs are required to be DOT compliant...
Your job as a driver is to ensure that you do your pre-trip and post trip....
If you find anything deficient....
It's your duty to report them to the company....
If they refuse...then it might not make you popular with the carrier and your DAC may suffer...but... I would throw the keys down....
What's worse....a bad DAC or wiping out a family because your rig was unsafe to operate?
And I did suggest the "anonymous" call to DOT........ -
Contact your labor board or whatever CA has, you will get your money back, but may need a new job. If you get fired for this then call a lawyer.
Ther in no "carry chain law" in WY, you don't have to have them.bordomzero Thanks this.
