    Please don’t take my exit from this thread as a sign of weakness and defeat.
    I’ve already presented my expertise in multiple Werner threads that eventually got shut down.

    I had planned on staying out of it when I first saw it, nonetheless I got summoned to the thread from someone needing me to weigh in with my superior intellect :)

    All for now, heading to the sidelines with my morning bag of popcorn.

    Some one sounds like one of those prosecutors that still stands by their decision to go after and put an inocent person on death row along with a bs jury eventho 20 years later dna and other evidence has prooved 100% thst person was innocent.

    With that logic she should not have been out there she was in the middle of the storm… And can you provide proof that DPS actually stated that in court, because according to their reports that they filed which are sworn affidavit essentially both the sergeant and the trooper ruled that she was at fault

    I think it was the right decision. The driver was in his own lane, driving below the speed limit and did nothing wrong. The other driver lost control and hit the Werner truck. When a vehicle looses control in winter conditions, generally it is because they are going to fast. It is sad it happened, but not the truck drivers fault.

    This is the legal lottery in action. The plaintiff's had absolutely nothing to lose by letting an attorney take their case on contingency.
    The Plaintiff's attorney decided to place a bet, with his legal time that he could get 35% of something.
    He went for broke, sued for an astronomical sum, and to his and his clients surprise got an award for $100 million.

    Now human nature kicks in. Greed.
    I don't know if a settlement was offered by Werner or not. Because of the potential precedent, I think not.
    So now the Plaintiff's attorney has a tiger by the tail. A company that MUST exhaust all legal remedies because of the judgement being held over them.
    I'll bet that the Plaintiff's attorneys wished they had never heard of this case.

    If the losing attorney was made to pay the winning attorneys fees, there would be far fewer of these types of cases filed.

    Frankly, I think what Werner should do is turn around and counter Sue, the attorneys and her for all of the legal expenses that they spent on them and the driver who was part of the lawsuit and bury these people for filing such a frivolous lawsuit… I’m sure the legal fees are probably into the tens of millions of dollars being at this lasted 11 years and God knows how many actions taken

    I think all the members of the jury should be sued for that bs decision nonsense they made. Send a message that they have absolutely no common sense in decision making.
