In a scenario like this, if they catch the guy, won't your insurance go after their insurance? Maybe he didn't hit you, but he's definitely still at fault, isn't he? Honestly I've never been in a serious accident like that (knock on wood) and I don't really know much about the process. Seems kind of harsh that just because he didn't hijack your truck and personally run it into the ditch he gets off the hook for damages even though he created that entire situation.

We discuss who pays and as usual, money is the bottom line on any event, BUT! the driver of the rollover truck is going to have to explain for years to come, why is this rollover on his record. Had he held his lane and head on collision or side swipe, either one of these would be much easier to explain than a rollover, especially if they never find the Cadillac and don't expect the search for the Cadillac to be very extensive
