Watch for bad companies

    The only times a case is filed in federal court is when its federal question (statute) or diversity. Diversity is if the claim is for more than $75,000.00 and the parties to the matter are in different states. So if you were filing something that didn't meet either of those, then that is probably why the federal judge kept dismissing your case. If it was not dismissed with prejudice, you could still file it in state court, though.
    What did they lie about, if you don't mind telling? There are lots of companies that advertise you can make "up to" $100k or more. There is also lots of things they aren't telling you or you are not asking about relating to how to make that much with them.
    Do you mean want you to lease their truck or do you actually own the truck at the end of the lease if you complete the lease successfully?

    I have been a truck driver for 15 1/2 years. Things where good until the pandemic. The problem is that companies lie on what they pay per year to get you in the door.

    Some companies just aren’t set up in any capacity for you to make $100,000 a year. However, the rule of thumb is if you want to make over 100,000 a year doing OTR work you’re pretty much gotta live out on the road. Stay out a month and only take three or four days off and that’s it. if you stay out two weeks and go home for four or five days which most companies will let you and you average that out over a year you’re gonna make about 15 to $20,000 less than you would have the other way. Right now freight is horrible. It’s been horrible for several years. I don’t know if it’s going to get better. For me personally I have a number in mind that I need to make to justify living my life on a truck. If that number ever changes then I will get off the truck and do something else. I Very much like the company I’m currently at and I hope to make it to retirement, but somethings are even out of a good companies control like the overall environment and the market. When it gets bad, it gets bad for everyone. The way you need to look at it how much is it worth for you personally to live inside a truck most of your life, if that number isn’t being met for you personally it might be time to rethink things and do something else.

    with nec cargo. my under standing of the law:

    employers can't create a contract that signs away protections such as indemnification law. so the contract is void even if you signed it.

    they must respect indemnification law which is the law about employer pays for costs that they or the job caused you.

    these are employment and contract laws, but employer can't misclassify you as contractor as effort to circumvent employment laws. so you will need to file that claim also. so employment laws will apply if they misclassified you and you called them out for the misclassification.

    lastly, record keeping law. if you signed anything pertaining to employment, then employer must keep that record and be ready to give it to you upon request. if not then this is a violation of record keeping laws. so if you lost the thing you signed employer must provide it upon request.

    as far as jurisdiction. still you state laws may apply in some cases, and federal in others. and fair labor standards act only applies to a few wage laws and record keeping stuff. so it's thing to consider but it's not man issue at controversy here in this case. i live in california so most of the stuff you mentioned here would be state law and where the employee is located, not the employer.

    IMO, only 99.5% of trucking ads and recruiters make up stuff, lies, anything goes, to get bodies in the doors so they get paid...
