Of course he wasn't on it at the exact time of impact into the van...he dropped it as he bounced through the median! sometimes these investigators really make you wonder how they are actually "investigating"!
-
Phone record's will conclude the exact time according to witness' time given being texting or talking. Still on the phone. Holding the phone and driving is illegal activity and it's the law. It's his ###.

Here is from the local news in KY

It also cost the lives of those innocent people..
Every time I see a driver in traffic on the phone I just want to slap them senseless...
It is this drivers opinion that 100% of all accidents are caused because someone was not paying attention....
#### it HANG UP and drive.....48Packard Thanks this. -
And it will happen again, and again, and again......some cell phone calls are so critical, so important that the lives of others is a non-issue!!!!
SICK, SICK, SICK!!!Last edited: May 6, 2010

The life and lives around me are more important than the life of the phone. It stays silent and I will check it when I pull over. If you cant leave a message then we really didnt need to talk. I will not jeopardize the lives of others because you want me to chat on the phone.
48Packard Thanks this. -
I have my phone turned off whenever I'm driving. However, a question:
Other than state laws (i.e. hands free, etc) are there any other laws governing cell phone use by people with a CDL? And is that different if you're in your private vehicle, much like BAC? -
If it's your bookie, or a special deal at some "Adult Specialty" shop...sometimes those calls are very critical...but one could at least pull over to "view the details"!
JustSonny Thanks this. -
I have seen signs in construction zones in IL that cell phone use is illegal. Other than that, I don't know, but laws and rules tend to not be obeyed by too many, anyway.
