That would be the state in question that OOIDA put a stop to the fatigued test.

They do not do the formal test anymore, but believe me they want to know where you slept the night before even though there are no regs requiring you to sleep.

Roadmedic, Your link is to CSA2010 and that is nothing more than existing regs. Still no enforement action can be taken on an opinion. IE: OOIDA vs MN

I know someone put out of service for fatigue. They did not sleep well the night before and THEY made the determination. The driver paid the fine.

Continue to believe what you want.

Look at some of the safestats on the companies and you will see where some have been placed out of service as well.

That's the problem, they have that stuck in their pee size brains now and believe me if they think you are tired regardless, they will find something to shut you down for.

But this is only their opinion. It cannot be enforced.:biggrin_25526:

I'm not rude to any law enforcement but, I'm not afraid to say show me the reg. If they asked I would tell where I slept the night before because it don't matter to me. I choose my battles wisely.

Some companies like Prime give a bonus for passing an inspection. I can't bet you if that cop is a prick he'll find something wrong with your truck no matter how tip top condition it's in. One guy I heard about was being a smart ### to the DOT man saying you won't NOTHIN' wrong with my truck. Trooper see's everything is in order so he walk's back to the spare tire rack under the trailer, pull's on the chain that goes around the tire and it breaks because it was so rusted. So much for the smart ###.

I wear glasses. My picture on the drivers license shows me wearing glasses. I do not need them to drive, I can legally drive without them. My medical card also has no restriction.

The DOT officer was going to write me up for false documents. His opinion.

I plainly told him I was legal to drive in Illinois and any other state. If he felt he HAD to write such a ticket, I would gladly see him in court.

I have no doubt that tickets are wrote for fatigue. The problem is when the driver pays the ticket: guilty as charged.
