I watched the video. It's almost 6 years old. The guy said they no longer charge drivers for fuel for idling.
The trucks have optimized idle now. -

Before opti-idle many companies would fire drivers for too much idle time which burns diesel. Caused a lot of headaches for drivers and trucking company owners.Toomanybikes Thanks this.

Lawsuit was first filed 2011, and later countersued by May in 2017, so long after opti-idle like technology have been in place.
I first heard about the system around 2000 from another mechanic. As he was talking, it had been in service for a while then.
I had the system first while driving in a 2007 truck. But, honestly don't know when it was first an option.
It is likely May did not purchase opt-idle and figured they could just get it off the driver.Chinatown Thanks this. -
