If they dig deep enough there is a video available. We had a discrepancy over some seals being missing on top of a dry bulk tank a few months ago that was refused by the consignee. The shipper was able to acquire a video showing the truck being fueled at a Loves. You could see the seals on top as it pulled forward.
When my son was in cub scouts we took a field trip down to a local K Mart and got to see the video room in the store where they control all the cameras. You could control them and zoom in close enough to record license plates in the parking lot and credit card numbers at the registers. Everything was recorded. That was 8 years ago and the technology is much better now.

I'll wait while you get the supporting info on that posted up . . . . . . .
395.8 1 and 2 clearly shows nothing of that horse**** your trying to push.
You rookies are throughly convinced your going to "RIGHT" the Trucking World with your assumptions based on twisted logic.
Ive paid "1" Log Book Violation in 30 years, had my Company Audited 6 times during the last 17 years.(they were requested audits but count none the less,we have a stellar reputation with DOT Compliance and overall Operations)
Running 27 trucks they found "NOTHING"!!
(Im currently down to 6 power units and no trailers)
You think I'm just lucky or something . . . . . ?

Boardhauler Thanks this. -
I know someone put out of service and ticketed for false log for saying they were off duty in a truck without a sleeper. The officer stated unless you have a qualified sleeper, you are considered on duty.
By the way, I am not a rookie and neither was the guy who got the ticket.
It depends on the officer. -
I know alot of guys who ....too
Failing to fight bogus citations such as that is the receiving parties problem.
Doesnt make the Law more/less right. -
I looked up the violations
False log 395.8(E)
14 HR rule 395.3(A)(2) -
Point is STILL!
You can not write a "LEGAL" Violation against someone sitting in the left seat
or right seat, logging in the sleeper.Much less have a 2nd rate Attorney try to stand on something as lame as a parking lot video of a third world take over
attempt by a terrorist driver sitting 4.5' from where they are logged in on line 2 of their daily 9" long life.
FEAR! and a good measure of text book ignorence is what motivates these clowns to dream up negative scenarios between DOT and Drivers regarding logging what is legal, the rest are just aspiring perfectionist attempting to shine on a public forum.
Some of you azzhats need a shot of 100 proof reality.

I personally do not worry about it.
In fact, I sit in the driver seat and watch them. -
Personally I do not worry either, but I will call BS when I see some limp wrist attempt at spreading wisdom concerning a topic Ive been well versed at for many years.
Drivers can work with-in the gray area's just as efficiently as the "Law"
Get to legalistic in your attempts and you end up looking like some of the ones that have posted to this thread.
Bottomline;
YOU CANT,BECAUSE YOU DO NOT KNOW!! -
The driver involved and his attorney decided not to pursue fighting the ticket. -
Naah,just read it.
Nothing to do with that, its those other 62mph wonders Im preaching to.
