Here's a question I haven't seen posed or answered.
What are the ramifications of a driver writing off (on his/her taxes) a charge back for fuel used to idle the truck ???
Way I see it......am I wrong ??
Company charges you X amount of dollars to idle truck. They claim IFTA and expense of fuel. What does that leave you ?? Legally ????
The companies I hear doing this, aren't providing the driver with a receipt. They merely deduct it from their check, which gives them a receipt of sort.
Would the driver be wrong to write these deductions off ????
If both file on these expenses, would one party or the other be committing fraud ??
Would it not be fraud to file an expense, if you recovered that expense PLUS a profit ???

I would see no problem with it.
Consider, that if the driver would have used Idle Aire for instance, it would be deductible. So, the same applies.
However, a cheap company, best to run without drivers. -

I am not sure what you mean by both.
The driver can write it off.
The company has an income item.
If you recover an expense, it is income when you do it. -
I wonder if some company is actually separating these fuel receipts and payroll deductions when it comes tax time??
Hmm, maybe I should plant a bug in the ear of the IRS and IFTA. And have them take a look at said company.

IFTA would not be relevant. The fuel was used in the truck. IRS, may be an issue if they are truly not reflecting it.
I am more curious as to why the FMCSA has not taken a stand on the idle issue and drivers rest. -
I truly believe they (FMCSA) are avoiding a conflict with the EPA.
While I agree the fuel was used in the truck. If the driver writes off the entire cost of said fuel. How is the Fed making any money? If the company claims it on IFTA ? Not to mention "business expenses".
Taking business expense out of the equation altogether. It would seem the Fed loses money. And we both know, the Fed hates losing money. Especially tax money. -
I would be careful about trying to write off the idling charge the company deducts from your payroll. I would think that if the company deducted it from your check, then they didn't take out the taxes on that portion of your income, therefore if you try to deduct it you would be deducting taxes that you never paid.
I think the IRS might frown on that.
You can deduct the Idle Aire because that is an actual out of pocket expense, paid for with income that has already been taxed. -
I would have no problem with taking the deduction and signing my name to the return. I am sure I have prepared more returns than you will ever think about doing.
