Warning for California CDL Holders

    well I'm out of work for refusing to violate HOS rules. Oklahoma says that it doesn't matter even if you resign while violating or not violating your toast. HOS rules are not a reason to resign at all. even though the Co. was cited by DOT! and you got a 2 week delay mine is until I have worked a year for someone else I wont be eligible for unemployment! so its not just Ca. its a bunch of these states. that was may and I'm still hunting work.

    welcom to trucking!!!!!! wont be the last time you get screwed, now that your eyes are open you now know how to play the game :biggrin_255: your fmcr book is your friend , learn what you can and cannot do and even more important what the carrier can and cannot do. also learn your employee rule book inside and out, use it to your advantage. buy a small pocket tape recorder that has a stickon phone attachment and use it every time you talk to your dispatcher or fm or anything to do with your company. now that your motivated make copies of your story and send them to your congressman and senator and to the director of fmcsa in washington, good luck and dont get tired and just give up, your friend and fellow trucker KING DAVID

WILL YOU LEARN GRASSHOPPER, its not if you win or lose but how you play the game, working for trucking companies is like playing chess, your move depends on their move and thats easy , ( to pick up and deliver freight on time inorder to make money for the boss and to keep safty off their butts and make the numbers look good for the rule makers ), its just that simple, now get out there and beat them at their own game, best of luck, your fellow trucker KING DAVID:biggrin_25514:

    I always log it as I do it, even if that means eating violations. Way cheaper, and safer, than doing false logs just to cover my butt. Besides, with electronic logs, there wasn't much choice there, lol.

    And, yeah, I thought that one through. But, the reason for leaving them was they used my financial situation, combined with my passenger's health needs, to threaten me into doing what I ultimately did. No point in hiding it, and thereby negate the reason I left.

    I have to agree with Blue, that behavior is S.O.P. for most OTR carriers. It's a gimme. Here's an impossible load, get it there legal as you can and don't hit anything or you're fired.

    On the lawyer, I doubt it. The State of CA. is broke. Dead Broke to the point they close public offices x days a month. They have IOU's on the street. Their pension fund was ripped off by Madoff but they still retain the obligation to the retiree's.

    If my DAC was clear and I have a new job ( like you do and many don't ) then I would take the lesson and move on.

    Of course a woman, might have played the "other card ". Certainly be more traction there. You could charge the FM with unwanted advances or something cool like that..... ( really tighten them up )

    Actually, I got a permanent disqualification plus two weeks (someone please explain that one to me). But yeah, glad to read someone got what I was writing about. Unfortunately, it had to be someone going through the same BS I am.

    Good luck, I think we'll all need it if this is commonplace.

    If YOU choose to bring a person with health issues to work with you and then THEIR needs interfere with YOUR ability to perform the work...Just exactly WHO's FAULT do YOU think that is?

    My wife rides with me most of the time...I run just like I do when she's not on the truck with me!

    Sometimes she complains about it...

    When she does, I tell her that when we're empty, I'LL TAKE HER TO THE AIRPORT AND SHE CAN GO HOME!

    BECAUSE....I'm at work and my passenger is not going to cause me to do my job badly!

    Before you accept a load you have to make sure you have time for the unexpected, thats part of trucking or being a driver. Is it fair, no but its part of the price we pay for what we do.

    The other option is keep a diary of all communications documented by time, date , place, call made, to whom you spoke, and subject. You have to build a case that shows a pattern. Not to hard most trucking companies build it for you. Contact a attorney. Oh by the way after you sue them you will need a new profession.

    Good luck. By the way I have left companies for not supplying a safe work place, and not following federal law and won. All I got was my unemployment. It's largely up to the examiner at EDD.

    First you call me elitist, then you make allegations that I am not truthful.

    And, I seriously doubt you know me. If you did, you would know precisely why I would NOT log lines 1 or 2 while in the driver seat, and why it became necessary for me to run 100% legal.

    Tell you what... Present your evidence that I have not logged it 100% as I've done it. While you are gathering your evidence, why don't you look up what constitutes libel.

    What was that? You don't have any evidence for others to see?

    Well, I do have evidence to back up my claims. Then again, if you really did know me, as you've claimed here, you would have already known that, not to mention the nature of that evidence.

    Then you can wonder if I'm the typical law suit happy Californian or not. :biggrin_25510:

    Btw, for you other drivers... It would appear this problem is not limited to California. I've been getting emails from several from around the country of having gone through the same thing, and fairly recently.
