my point is here you bmi dont have sh** to do with sleep apnea .liek this we have cops here where i live he is about 6ft 3 he is about 300 pds but all muscle he would fail a (BMI) test to prime .but is in great share for chassing the bad ppl down the road or jumping a 4 foot fence but cant drive a truck?

If they wouldn't hire you because your black or female or old even thought you are qualified to do the job,that would be discrimination.So how is refusing to hire someone because of their weight not discrimination?if I can pass the physical exam and driving test then I'm a qualified driver whatever my weight is and this type of hiring practice is illegal.
Maybe all of us fat drivers should file for disability and just let all you skinny folks take care of us. Or maybe we should start filing lawsuits against these companies under the Americans with disabilities act.mikebrown611 Thanks this. -

or maybe caycejunior let them pay for the sleep study test for us and see how there families like not getting the $1000.00 dollors that they might need to live and for a new driver that be about 1 and 1/2 weeks pay or more

Er... It may be a nitpicking point, but the 2% figure can't be accurate. The people who survived the Nazi deathcamps came out with around 2% body fat.
Anyhoo.... I know it sucks to be turned down for a job, but in this case, the required pre-employment sleep study is a dead giveaway as to WHY.... T'ain't a discrimination thing. There's a lot of well documented studies that link a direct relationship between obesity and sleep apnea. Since the cause is internal fat distribution, the ONLY way to rule out apnea is a sleep study.
I don't mean to offend, but personally can't fault em for having the policy. It's a safety issue rather than discrimination thing.
(just in case anyone's not familiar with it) Sleep apnea is an frequently un-diagnosed sleep disorder where the subject stops breathing for short periods before achieving R.E.M. sleep. Patients begin to wake, but usually begin breathing before full consciousness.. This cycle repeats causing health issues and sleep deprivationLast edited: Sep 16, 2010
