yup it was the previous 5 day part I forgot.
If you start and end at the same terminal. and you had done so (no overnights) for the previos 5 days. You can use that 16 hr. exemption I drive local and otr both and I use it all the time. We just got audited and that was not one of the things we got in trouble for.

We are not going to jump anyone on this board about being wrong. Someone being wrong does not mean they are not knowledgable. Again I could be wrong at this! I don't preach the 16 hour rule @ all except to my local guys and that's it.

there is no "technical" distinction between local and otr. I do both from one week to the next so what would I be listed as? ..... You be quit Logs, I hear the wheels turning already after asking that!

There requirement for using it is that you have started and finished at the same location for 5 days. SO if you have done that go ahead and use it and make a note of it on you log. You're good buddy -
Just remember that anyone who is allowed to use the 16 hour thing is only allowed to use it once per week, and you still have to take 10 hours off.

That part I know for sure! I thought they had to be running local for the prior 5 days and I knew they could only use it once in a week. I wasn't 100% sure on the other. I only tell the local drivers they can use it and will probably always be that way, it's just safer that way.

I'll stick my two cents in here. I'd log it like I did it. With a note in remarks about staying ahead of the weather (or what your reasons were). Be prepared for when your "called on the carpet". During your meeting with saftey, remind them that you are trustworthy. That you did "stretch" the regulations but DID NOT hide it. I believe that most companies will give a break to an employee that is honest about overstepping his bounds. You will most likely be in their "spotlight" for a couple of months. But whats the worst that could happen... take away your birthday? Even if fired, when you apply at another company be honest about why fired. I believe honesty counts when handing over a $90,000 truck with a load worth $$$$$.

You're right about that part too. I've had to do that several times where I work, at the expense of the next night's cut time, of course.

i guess i'm the only one who is gonna be totally honest here. i would not log a 16 hr day for any reason what so ever. i'm not giving DOT any reason to fine tooth my log book or my truck cause no matter how legal it all may be, they will find something. personally i would log the 14 on friday, wait 10 hrs and log the last 2 for saturday. i would be at the house when i did this and getting the 34 hr restart the short day won't hurt. if you have done any kind of serious time out here you know as well as i do the log books take some doctoring. and that is where it gets tricky. this is just my opinion. i run as legal as posible but sometimes i move hours around that day so i can keep moving for that next load.

Cerberus: Actually if you don't have violations sometimes it causes them to look harder. DOT would rather you be honest than to hide it. Less likely to get a fine. But your advice is welcome as I figured several would state the same as you, even though I am reading here
