Job offer from a local O/O

    If you have a good tax man, the bracket you will be in will be about 10 to 15 %. It is illegal for him to run you on a 1099 if you drive his equipment but it still seems to be very common in this industry. $90 per week coming out for insurance for the family is not bad depending on the coverage and it would be tax deductable.

    That 1099 stuff can get you in deep debt with the IRS really fast.
    I believe you need to file every 3 months too..

    I see ads around here all the time for 1099 drivers...most are still paying a low percentage or 32 to 35 cents per mile.:biggrin_25513:

    I got caught up in that crap back in 85 and 86 and took forever to settle up with the IRS. I ended up paying them over 40k...:biggrin_25510:

    ANY company that says its a contract or 1099 job i run away!

    If he is responsible and sets the money aside and pays when he is supposed to it shouldn't be a problem. the problrm seems to show up when you dont file the taxes because you didn't set it aside or pay quarterly the way the IRS wants you too. You find out what you owe then just keep putting it off until you get cought or can't handle the stress of knowing you owe it. Now you have to try and catch up and interest and penalties have accrued.

    If you take the job, pay when you should and get a good tax man that will get you every LEGAL deduction he can.

    Working as an employee on a "1099" is ILLEGAL,......

    Does the employer pay into workman's comp insurance to cover you if you get hurt on the job????

    Is the employer paying into social security????

    Working for a "1099" is a BAD IDEA,.......

    I hear and understand your reasons, and I appreciate your concern. However with most of my CDL work being what the industry calls "local," I've found myself in a jam. They want 6 month OTR verifiable in the past 36 months, and Im fighting tooth and nail to find something that will work for me. But this O/O figures with such a high recommendation from my previous employer, that Im the guy for the job.
    The insurance is expensive, Ill ask about workers comp. When my finals are over I need to be OTR. Maybe just for the 6 months I need to be eligible for other employers, and maybe longer. Between my uncle who's an O/O and this board I've figured out my taxes, and as long as I stay on top of them I've got to give it a shot!

    Payroll taxes (social security and medicare) alone would be 15.3% since you would have to pay both employee and employer portions. Then add federal, state, and local(if applicable) income taxes on top of that.

    I would not trust anyone trying to pay employees on a 1099.

    Agree 100%!
    No insurance,no workman's comp,no social security...
    Pretty much if you get hurt on the job you are SOL...

    Plus the added aggravation of having an accountant and doing taxes every 3 months is so not worth it unless you are earning some really big money.

    Look on Craigslist and see how many driving jobs are 1099 with low pay...unreal!

    Or he holds your half of the taxes out and pockets it. Then at the end of the year you find out he did not pay any on you. Your both in trouble now for not paying taxes for a year. He got at least half of yours tho....:biggrin_2556:

    Why do you want to be otr? I've never been otr, or logged even one minute sleeper time in my life. I don't even fill out a log book. I haven't in years.

    This job offer is considered OTR, but I can be home every night. Its decent money and local driving jobs aren't plentiful around here right now.


    And before 10 more people post the same thing about not trusting the 1099 guy, please read my pst above #15. I haven't been offered a position after they realize I haven't been OTR for 4 years.
