    Is it legal for a trucking company to fire a driver if he makes a decision that he is too tired to drive? Seems to me that DOT has regulations in place so that drivers will not drive without adequate sleep. Granted, it is the drivers responsiiity to try and get the necessary sleep during his/her off-time, but there are unavoidable cercumstances that can cause ANYBODY to not be abe to sleep. Seems to me it would be MORE Irresponsibe to get behind the wheel KNOWING that you are not in any condition to drive, wouldnt that be considered negligent homicide if you ended up in a fatal accident. E-mail me your thoughts, and stay away from 3PD. Even when I worked for Werner they were understanding of the fact that #### happens that you cant avoid sometimes.

    trucking companies cnat fire you for following the fmcsr rules of not driving while fatigued. but they can make up some reason as to company policy that you broke to fire you. so as to cover ther backside. its a game they play you have to play it better

    I worked for 3pd for 4 years and they suck. They will fire you in a heart beat. They screw with your pay and they work you like a dog. Run from this company as fast as you can. They treat you like an employee and expect you to do what ever they say!!! If you refuse them in any way they make sure that you do all the crap loads.

    Sure they can, if your need to sleep makes you late for a pick up or delivery. "Service Failure", also known as failure to abide by company policy. Nice how they keep everything phrased so they can claim a safety violation one day, and a company policy violation the next over the same situation, and still drop drivers like hot potatoes, yes?

    were you an "at will" employee? if so, they can fire you for looking at someone the wrong way. as long as truckers are "at will" employee's, you will have NO rights, except to shut up and do as you are told.

    You got the wrong definition of at will. My definition means truck don't move unless unless I will it to. Ain't nobody succeeded in taking my rights away, other than the fat turds in the government with very limited success, and I'm not hurting for work. And if I was, I'd be doing something else. Cause I have that right.

    at will employment only goes so far...there still are laws protecting workers.

    true, but if you think they are upset over being tired, they won't put that down. then you might have a case. they will put down something like "we don't like your attitude", or "you waste too much time". at will employment means they can make up a reason to fire you....

    "At will" means you the employee, or them, the employer can terminate the "agreement" at any time witn no reason needed or any notice given. Read the paperwork you sign when you hire on.
