Heard this straight from a FMCSA representative being interviewed on the Dave Nemo show...
Only infractions documented on a CMV inspection form will be included in the CSA 2010 point system. Something any LEO tickets you for that is not included on an inspection form will not be included in CSA 2010 - at least until the ticket nazi's figure this out!
Got a ticket in Cali for having my axles set back 40+ feet. Point violation?

True that.....but if during an inspection they find a tail lamp out....You can replace or fix right there...but you'll still receive the points for a safety violation...
-
by your statement you new it was illegal to pull the trailer and took the chance. But in regards to your question this not a moving violation but under the giudlines of the new cvsa 2010 there is probably a point issued but not necessarily against license.

Since you gave up your God gifted rights and became a citizen of Kalifornia you will more than likely see it as a point on your record.
They love some truckers out there! I got my license switched to Texas and to tell ya the truth I have never been greeted so well in all my born days like that by a DMV/Department of Safety official. I always go back to Kalifornia my Mother is still trapped there and so I go behind the Great Wall of Kalifornia as much as possible to help her to smile till she decides to escape she has been conditioned to stay and so it won't be easy getting her out. -
That ticket will be $186.00 and no points...Ask me how I know.

I made the same mistake and ended up on the 580. When I realizied my mistake I got off in a bad part of town on some very tight streets, but finally found my way out of there.
