Unpaid miles

    I posted this in the newbie section & was suggested to post here instead. We are new to all of this so, apologies for duplicates.
    My husband is new to this industry, as am I. I'm hoping to find some information to help us.
    He worked for a major trucking company and agreed to a six month contract. He was home all of 6 days in his first 4 months then agreed to have an owner/operator buy out his contract. Since then, he has not been paid one red cent.
    He has 4 weeks left to fulfill his six months but we are fearful about what happens next. Is there any recourse to get his wages back (now or later)? We figure it will be a wash between the loan to the company & his pay. When he hits the 6 month mark he plans to walk away, expecting loan= his pay. What can the o/o do to his dac (sp?) report?
    We are new, confused & concerned. Any advice is very much appreciated.

    im kinda having a hard time following you? I have not heard of this before.

    Your husband signed a contract? i know we all sign contracts when we sign on with a carrier like myself as a owner operator but i have never heard of having to have somebody buy out your contract??? usually you quit or get fired. and you dont owe the company money for future loads you might pull.

    But maybe im misunderstanding something here or maybe one of these vets with much more experiance then me "ive been around trucking all my life but only a driver for 6 years" maybe able to help you.

    I have been in this industry 30+ years and never heard of such a thing. The only thing I can figure out is your husband agreed to a lease purchase type deal and if in 6 months he wanted out he had to find someone to buy out the deal. I have read some lease purchase agreements that have a buy out clause but he's still due his pay. It's unbelievable to me what some of these companies do now and the lengths they will go to get people to drive. Sorry if this doesn't help much but I simply never heard of such a thing.

    Good its not just me that has never heard this brfore.... i bet its something like that lease purchase but then it doesnt make sense because she said a O/O had to buy out his lease?? LOL i dont know either we need more info!!

    MY interpretation is that the driver agreed to drive for a carrier for 6 months in lieu of paying for training. Part way through the 6 month term an O/O leased to the same carrier bought out the driver's contract/paid out the driver's contract in order to secure a driver. Since working for the O/O the driver has not been paid.

    Say What!! I still never heard of such a thing and regardless he's still due his pay. Something ain't right here.

    My guess is that the driver is in fact working on the six months to pay off school, but got involved into a lease purchase deal as well.

    Yeah I did. See above. Still sounds like some lease purchase type deal. I still never heard of an O/O buying out a contract with a company. OK, the guy went through the school,agreed to pay for the school, OK, now he's decided it ain't such a good deal and wants out,OK, he owes the company for the school, but I still never heard of an O/O buying out said contract and not paying the driver. Regardless of the O/O buying the contract he still owes the driver for work done (no pay for weeks) C'mon Man. There' s still payroll deduction. Just not enough info in the post and like I said "something ain't right".

    Yes, yes, yes! Thank you for interpreting for me. Again, we're new to this, he's otr & I'm explaining what he's telling me... Anyway, yes, he obligated himself to 6 months in exchange for the training. The o/o (a leasee from the company) made a really sweet offer: more home time, higher pay, etc. The leasee, I guess I should call him, hasn't paid my husband ever. He took a loan from the company against the balance of what my husband owed. Does that make sense?
    Basically my husband owed the company time or money, & this guy assumed his "debt". Somehow, he's working for free.
