From my experience when I was a Navy Recruiter, just because it is said to be removed, it is technically still there. The courts just cant use it against you in the future. How ever, when I would have an applicant that says he never did anything because he thinks it is erased, it would come back on there and they would be hammered because the falsified documents. (Just discharged) The Police Record Checks would almost always come back before they went to boot camp, so they would just be discharged and it would go under their SSN incase they tried to go to another town and try to join. I am not a Lawyer and do not claim to know for sure, but I am just telling you what I experienced back then. I had more than one applicant or parent tell me that the offence was supposedly removed from their record, but the Navy still got it. I could not tell you how many slipped through.

Back in Jan 0f 06 when I was in cdl school I had gotten 2 letters from USIS, for US Express, and Covenant, background checks, both stated, I had gotten a ticket back in 1983 for a broken tailight, thats was all they had dug up. The tickets that I had received on Fort Bragg, did not show up. Federal property.

This may be on your record indeed forever, but if you make the right move no one will be able to see it outside of law enforcement agencies. All you have to is get it expunged (sealed). And even then, I think a court order is needed for law enforcement folks to view it in any case except for something involving a future crime.
Call a lawyer and get it expunged, wait a few months, and then reapply with Roehl.
I know lying sucks, but sometimes telling the truth will screw you over. You already know this as well. If I got this thing expunged, I'd definitely keep quiet about it in the future. I'd not even put it on applications with trucking companies.
Don't ask, don't tell. It works in the Army. It can work in private industry, too. Get it expunged. You'll need a lawyer to do it. That's it. That old crime is nobody's business. -
Longbed let us know how you make out. I agree with Tip. Get that off your record and recontact Roehl. When you get it off, bury it and don't offer that information to anyone.

Remember guys and gals, they did not run any type of report. I didnt give them any of my personal info, so how would they know if I called again? I was just answering questions asked by the man who I spoke to. I was actually pleasently suprised he was asking these 'need to know' questions over the phone. Usually thats stuff asked in an interview.

OK, here is the skinny on criminal records and such. I was a Police Officer for 8 years.
Juvenile records are not sealed, and there is always a record. They are not suppose to be "used against" you as an adult. Further, the reason that many jurisdictions choose to charge certain crimes that juveniles commit as "adults" is for stiffer sentencing.
Not all jurisdictions report misdemeanor charges to NCIC (National Criminal Information Center) or your states criminal information center. This is why sometimes folks have so called clean record, but other things show up in LOCAL AGENCY CHECKS. A local agency check is just that. Someone has to physically contact each agency in every area that you have lived; they usually do this in person. Not only do they get information on crimes that are not on your criminal record, they get tickets of any type, they can also get any police contacts that you have had. Say you were the reporting party on a theft that you witnessed, and then you were contacted on 4 other occasions at a known trouble hole, and then you had another contact where and officer helped you change your flat tire. Every contact that an officer makes, good or bad, is usually recorded locally.
A private company, unless engaged in government contracting can not get your NCIC criminal report. Each state has their own rules on disseminating state records. Don't confuse that with that they can not get the information about your misdeeds. There are private companies that consolidate and buy information on people, and they very well may have your misdeed recorded, which can then be verified by a local agency check.
Concerning criminal offenses on military bases, military offenses and tickets on military bases. The military does report all Courts Marshals and criminal convictions to NCIC and the state criminal information center in the appropriate state. Further, some Article 15's are reported. Some military bases, which are hit and miss, report traffic violations to the state motor vehicle department. As far as "local records" checks go with the military, unless you have good cause, you are not going to get much help from the military if you are conducting a local records check.

Thanks blackcat, I appreciate the info. I just want to be sure I will not get turned away once I get up to Ellenwood. I told him about a 9/05 accident where I had no insurance, no tag, and failure to yeild. I figured that alone would cause them to turn me away, but the guy I spoke with said we may be able to work with you on that. Ill see what I need to do to get it sealed, and if that doesnt work, Ill just roll the dice with them.
