Help for Short Haul Drv Taxes

    I have an odd question. Just went from an over the road driver after 4 years to a local grain hauler. Half the time we run in the 100 mile radius, but the other half we run outside of it and have to log it. Most of the time we are home every night, but sometimes we are not. Can I claim the 59/day on any of it? I was told that I can only claim the days we are out and have to follow HOS and fill out a log book.

    Any help would be appreciated.

    I think someone told you right. I'm not a tax expert, nor do I play one on TV, but I can't think of a reason why you can't claim the per diem for nights away from home, unless the company pays all of it. You could even get "creative" and generate bogus log entries for days not away from home, but that would be criminal. :biggrin_25525:

    In the (unlikely) event of an audit, your log book is your proof of time spent away from home. Just add up the days at tax time and hold onto the logs. You might want to ask your tax preparer rather than rely on info from a trucking board.
