All of your talking points are flawed
1.Speed limiters?(hey this isnt Canada) we are a talking about,in no fashion has this been brought up,and we already have 'speed limiters"there the white signs with numbers on them on the side of the road
1a.Your trucks(btw how many do you own?) lets say you have 3,ok one of your drivers has more than 1 citation in a given period of time,now 33% of your "company"is not safe and comes under the full scutiny of the FMCSA and now your required to have EOBR's on board all of your trucks,that would be fair RIGHT? I mean its the same criteria that you propose for the "Large carriers"(So where is your point about 10%vs90%
2."Forced to buy a product in order to make a living"? you cant even compare that to the Flawed health care bill,are you not REQUIRED to have a CDL$,Insurance$,Authority$,Pay road use Taxes$,Base plates$,hell even paper logs$,need i say more?(Its called a operating cost) ask your CPA im pretty sure you guys will be able to "write it off"
3."Level playing field"? so as you said your trucks can "bury the speedometer" and company trucks cannot(I BTW have no prob with "Governed" trucks for the sake of this argument) but if you want to make a Apples to Apples point instead of Apples to Oranges if all the trucks out here were not "Limited" would it then be fair?(Wouldnt be safe)
It is all about safety:admit it! you know it is! but you want to make it sound like all the larger companies conspired to make this happen
,NO just look back in all of your years of driving and remember all those trucks you saw;
A.In the ditch wrecked
B.At the scalehouse with a sad look on their collective faces
C.Sitting at the Truckstop eating a meal and reading "The Trucker" and you see a truck accident where the truck ran over some poor car
D.Some lame ### driver baking into your hood cause he to tired to pay attention
E.Drivers speeding through construction zones,hell speeding in general(we tend to forget its the law,not a suggested speed limit on those signs
(Feel free to add anymore to this list)
Need i say more???? I mean really I understand what your saying,and no i have never owned a truck and or a truck company but your logic on this is what your saying why even bother with HOS at all?
You just have yourself this very question then;IF you and your company is/are this safe why would you be afraid to EOBR???

The problem most people that are against EOBR's is the 'big brother government' that thinks they need to stick their noses in where it does not really belong. Just more regulation being aided and abetted by the large companies that think they need an even bigger share of the pie and want to see the small companies (which they were at one point themselves) driven out of business.
Do we really need more regulation? How about some logical HOS instead, and tell the so called 'safety groups' to go pound sand? All the 'safety groups' do is skew data to suit their purposes while not targeting the real problem drivers at all . . . the 4-wheeler.Roadmedic, virgil tatro and panhandlepat Thank this. -
The saddest part on the EOBR issue is that 5 companies, the large ones called for it and agreed to this.
No matter how you look at it, the new HOS and these EOBR's will cause a reduction in the earnings a driver makes.

The current HOS is fine I dont see how you can honestly say they are not safe?PLZ EXPLAIN
The EOBR is only a electronic log,it dont make it unsafe YOU the driver determine the safe factor in the equation
So with your thinking that the current HOS is "unsafe" so you have been unsafe for the past 5 or so years? Have you not made a living under these conditions?
The current 10-14-70 rules (with 34 hour restart also) are a far better deal than the old 8-15-70 (no restart) can you not deny this? and it is a lot safer out here.once the current HOS went into effect it finally gave the DRIVER power(14 hr rule) to shut their respective day down,and your log book was not run by someone over the phone
If its true what you say about 2001 i sir commend you on this accomplishment.
I to am at near 2 million miles myself(1.8 to be exact) (1 preventable accident,no one hurt but my pride due to me at 12mph and a bridge with black ice and a curve cause me to loose control and slide into the guardrail
But more importantly I have had a license since 1978,and have been a Holder of a CDL for 14 years now and in all of that time I have never:
Received a ticket for any moving violation(only been pulled twice since 78)
Been put out of service(hell in one year alone had 6 DOT inspections in Ca) during a DOT inspection
Received a ticket for a Log book violation
Not "thumping my chest" here just saying I follow the law,and thats my point in this all here,its not about if the EOBR's are right for me and not for you(or visa-versa) or anyone,,,Its just a tool to get your job done right and correctly and legally and the most important thing,,,safely
Ill ask you a question,and plz give me a honest answer,,,
If the EOBR's in just say 1 calender year exposed all the BAD drivers and it caused them to get off the road,would that be a bad thing?
It would make the road safer for you and me correct?
I too felt the way you did prior to recieving my 2 hr block of instruction on the EOBR(ours are Qualcom btw) and I sat in the truck the first weekend just frustrated and scared i was doing it all wrong(there is still a lil frustration from time to time btw) but all in all i am more at ease with it now after ten days.
And yes I have a idea or sense what you O/O's are saying about the cost and all,but like I said in my original post,,GET THE FACTs on cost before you go off the deep end and worry to death.If you hear it word of mouth your just getting someones opinion(or what they herd) and thats about it
Just look at EOBR's as a tool,learn the thing and see how it will improve your operation,if not I suggest you get a good price on your equipment and sell them(trucks) as if you havent noticed in the past 10 years CRASH&PATT will not be happy until they are REQUIRED,its inevitable as change always is
