I don't know why your company suspended the both of you, they still have to carry the points even though you don't work there anymore. What did they gain by letting you go ?![]()

I think they suspended them so as not to 'fire' them therefore they don't have to pay for unemployment or face an unfair termination suit or something of the like...
wildbill123, THE PLAYMAKER, 123456 and 1 other person Thank this. -
yeah, i am continuing to read the site, and then come here...it depends on when it happened...6 months, 1 year, 24 months ago....
and it does appear after all. there is a 30 point cap in all the basics...now (as i read it) the o/p's 14 points x's 3 is really 42 points...!!!
so suffice it to say, the o/p got toasted......and since it was part of a team, the wife suffers as well, in the loss of the job, but no CSA points on her......unless she got "tagged" for not keeping her log up to date as well...???? -
that can go up for a review at the unemployment office, sometimes, one can collect unemployment benefits.Sacred Feline Thanks this.

they will collect UI in florida. -
I guess all the real truckers are retired now. I said many years ago, "as long as truckers continue to ride up and down the highway with their tails up their ###'s they are going to keep taking and taking." Which is exactly what they have been doing. It's not going to stop with this CSA thing. Just like the fuel prices didn't stop rising 10 years ago. The gubment knows they got us by the nads and everyone just rides up and down the road wishing they had a backbone.
Jagman Thanks this. -
I read all the post. Now this driver gets an atty. sets a court date, then the officer comes up the the bench before the judge. Officer- "The reason I pulled them over, your Honor, they were speeding. But they told me this story, his wife was sick, but why didn`t pull over 3 exits ago, your Honor?"
I like this post, good lessons to be learned.
Thanks Rerun8963, you are always welcome to give the facts of trucking. -

I would like to thank all of you that offered helpful suggestions. I have hired a lawyer and was told there was a good chance the citations could be reduced to a lesser charge. This does not go to court until 3/30/11 so everything is still pending.
It is not my intentions here to sling mud on the company I was driving for. I happen to think they are a good company with good people. I will miss driving for them and all the friends I made there. Let me make something clear here. I know DOT did not force the company to suspend us. The company made that decision. I do not like the decision but I do understand why they made it. They did not want to suspend us, they even told us as much. They did it to cover their butt.
Now let me explain why. Under the new CSA rules when a driver gets a violation the driver gets points on his PSP and the company gets points on their safety rating. When Dot goes in and reviews a companies safety performance and it turns out bad the company better be able to show they are doing everything they can do to improve their rating. A company can not fine a employee like DOT fines them so all that is left is probation, suspension and termination. This is why I am saying these new rules will do more harm than good. A lot of good drivers are going to be fired because they were unlucky and got a citation. Remember even a warning will get you and the company points. You don't have to get a citation. These new rules are forcing companies to take action against a driver that they may not have before.
Let those of you without sin cast the first stone. We all have seen drivers on the road and you have to wonder how they ever make it from point A to point B. No matter how good you think you are, or how many years you've been driving everyone of you have broken the law at one time or another. Maybe it was something simple like going a few mph over the speed limit, driving through a yellow light and looking up and see it turn red before you are through the intersection or shifting gears on a railroad tracts. These things are minor but can get you a citation.
I can see by the posts here everyone had an opinion. I feel like my wife and I are among the first victims of the new CSA rules. Maybe when it happens to you or someone you know you will change your opinion. If enough drivers loose their job maybe DOT will realize instead of making the highways safe they are putting people out of work! -
I see some of you are adding up my points. Here how our safety director explained it to me.
7 points for 14 hr violation.
7 points for false log.
7 points for a warning for speeding 1-5 mph over the speed limit.
------
21 x's 3 = 61 points on my PSP for 3 years
He told me that this was worse than failing a drug test.
What really gets me is the company doesn't give a rats ##### that I did what I did. They care that I got caught. We were suspended so the company could show DOT that they were doing what they could do to improve their safety rating and to keep from getting a fine on their safety review. This is why I am saying CSA will cost drivers their jobs.
