And here is my 2 cents FWIW.....I can not believe the disparity each STATE governs safety of vehicles ie inspections. In NY you have to have a comprehensive vehicle inspection each year that include many basic safety features such as tires and brakes but also more comprehensive safety inspection features. If your vehicle does not pass you do not get your inspection sticker until repairs are made [colored coded differently each year to easily spot on the lower left windshield] but many states such as Ohio have NO inspection and can drive about freely in MY state with quite ppssibly faulty equipment!!!! Why don't ALL STATES adopt across the board safety vehicle inspections much the same as CMVs are held to?????

While I understand where you are coming from Dave, it ain't gonna happen. (I'm back to the HOS bit here.) It is just not realistic, and lets face it, the motoring public flatly would not stand for it. Just see how quickly state legislatures actually DO respond to something when there is massive public and media outrage.

As for random drug testing? Hell I am 100% FOR it! At least until drug laws are changed.

All states that I have familiarity with, do require equipment standards for all vehicles. However, they are not necessarily enforced. I am in disagreement with that too.

The state vehicle inspection requirements SHOULD be mandated in all states, and equipment violations should be dealt with by law, when they are observed. It doesn't require a traffic ticket to get MOST people to get that turn signal lamp replaced. But there are SOME that issuing the ticket and fining them is the ONLY way to get it done.

    Not in my state.

Log violations are ALL misdemeanors around here.

Also, mistakes do not make a log book false. False entries to conceal hours of service violations get you in trouble here.

Don and what you said about inspections is what I said but the problem comes in that for most a ticket will not get them to fix that violation and they continue to drive their POS VEHICLES!

There are states where if this happens, the vehicle is impounded at the owners expense. Then they get to pay a fine, pay the towing and storage, and the repair MUST be done before the vehicle is released.

Of course, for the ones you are talking about, they probably never bother to get them out of the impound. They probably just go on and get another POS that is in as bad or worse shape. . .

I was sitting in the passenger seat of a deputies patrol car while he filled out my ticket for not wearing my seatbelt. I was driving my pickup and not wearing a seatbelt was a primary offense in that state and that is why he stopped me. I asked him why we had a seatbelt law. He replied with what seemed like a canned answer about my safety. I then asked him what would happen if I didn't pay the ticket. He replied that I didn't have to pay it as long as I showed up in court to deal with it. I asked what happens if I don't pay it and I don't show up in court. He said that most likely the judge would issue a bench warrant for my arrest for failure to appear. I then asked what would happen if I didn't take care of the warrant(he was patient and professional while playing along with my little game, I give him credit for that). He said that if I were stopped for anything, and had an open warrant, I'd most likely be arrested and held in jail until the judge had a turn with me. He did start to get a little short with where my curiosity took my questioning next. I asked what would happen if I didn't allow myself to be arrested. He said they have tools to deal with people who resist arrest and if they decide to arrest me, I will be going to jail and will have additional charges piled on. I wanted to take the conversation to it's logical conclusion so I asked what would happen if after using their "tools" on me they still couldn't subdue me. He was pretty much tired of me at that point and stated that if he felt his life or anyone elses what in danger, lethal force would be justified. My final question was, "why do we have a seatbelt law"? He began to answer but stopped, handed me my ticket and said "you're free to go...please do." Before I left I suggested that the seatbelt law wasn't about safety, as he'd just explained that the state would rather kill me than allow me to be disobedient by not wearing it. I claimed that at any point along the escalation, if I submit and become obedient to the government, I will live. However if I choose to not submit nor become obedient it will likely lead to my death. Before I closed his door, I said "don't worry, I'll pay this because wrestling with cops is way more dangerous than driving without a seatbelt".

I often ask cops and politicians (when they'll hold still long enough) if their laws were so good for us, why do you have to threaten to kill us to get us to go along with them.

Lesson #1 for cops; don't let political antagonists like me in your car while you're writing them a ticket.
