    How come it has to be after the person is gone their hailed a hero? This is a sad story, to many times 4 wheelers cause tragic happenings for truckers. They always want to do "studies" on how truckers can better drive on roads, how about doing a study on how 4 wheelers can make driving conditions better for truckers?!

    Unfortunately, no matter what is done, it won't stop people from driving like maniacs on the road. You will always have those nuts who think it's fun swerving in and out of traffic endangering the lives of everyone else.

    Those that caused this incident are all in custody and I truly hope that the books are thrown at them. But that is wishful thinking. Like one lady said, they should be charged with murder and I totally agree.

    The trucker, David Virgoe, had 26 years of trucking experience and never an accident. And now he's in heaven because of 2 morons.

    I'm curious if the driver would have been portrayed any differently if he had lived? Would he have been charged with a preventable accident? If so, do you think he'd still have a job with his company--would another company hire him with a preventable accident and a totaled rig on his DAC? Would he be told by his safety dept or troopers "if you weren't going so fast (even if he was only doing the speed limit) you would have been able to look ahead and had time to stop?" He dithced his truck in order to mitigate personal injury to others; his actions certainly appear intentional. What if instead of driving his truck into a guardrail he had stayed in his lane of traffic and based on eyewitness reports that most certainly would have meant he hit the swerving cars--injuring the occupants and quite likely sending them into other vehicles? In that case, it would seem he wouldn't be charged with a preventable accident (assuming the cars swerved into him.) I'm still a rookie (just at 1 year OTR) and in my first snow storm I saw a driver of doubles darn near put it in the ditch when a car darted in front of him and then came to a complete stop on the highway. It was a lot of skill or luck (or both) that allowed the driver to recover and stay out of the ditch. From a DAC standpoint, the driver was hosed either way--either penalized for putting it in the ditch or penalized for rear-ending a car--even though the car afforded the driver no warning and no room at all to stop. I hope if ever faced with such situations I am able to react in a way that is in the best interests of the motoring public, but I sure hope I never have to make such a decision.

    One of the accused was released on bail a few days ago, while the other is still sitting in jail. Reasoning is because the other family had money for bail. The attorney general is working hard on getting the accused that was released back in jail. They face several charges, including criminal negligence causing death by street racing. If convicted, they could face 14 yrs, but I highly doubt that will happen.
