Sundance Express

    My husband leased on with Sundance Express LLC owned by Jeff Gaslin. The VP or Operations helped us get set up and assisted us with documentation. After that, we tried numerous times to call the owner to introduce ourselves and meet with him.Everything was okay in the beginning until we attempted to amke contact and communicate with the owner. We never could get a hold of him or return our phone calls. It took a month before we spoke to him and met Mr. Gaslin. Also, when it came time to getting some answers about how he would like his paper work handed in, again we received no answer or return phone calls. So, we had to make some decisions on our own which he finally then decided to contact us because he was not happy with our decision. So,we then were advised of how he wanted the paperwork and so forth to be done which is as follows:

    1. We had to fo our own billing.
    2. We had to do our own dispatch.
    3. We had to pay our own cargo and liability.
    4. We had to pay his company for filing the IFTA plus the previous turck owner's IFTA truck fees.
    5. The previous truck owner owed him fuel money which he was telling us that instead of making a truck payment to the previous owner we were going to pay him or he was going to take it out of our settlements.

    Then here are some other issues.
    6. To this day he still owes us $1,228.17.
    7. He is pulling a trailer with a tag that does not belong on it.
    8. When he terminated our lease on 4/15/11 effective 5/1/11 he advised to not call him because it was harrasement and that he was confused about who owned the truck. (I forwarded all appropriate documentation to end his confusion, i.e. lease aggrement and copy of contract for title).
    9. We only received 3-4 settlement break downs out of 14 loads and we have only been paid/partially paid on 11 loads. The last three are still unpaid.
    10. We had deductions taken out of our pay which there never any documentation explaining why.
    11. He has been known to have unauthorized drivers as well.

    I could go on with a couple of more but this should be enough info to give you an idea of how this owner of Sundance Express operates.

    Pretty much we did everything and paid for everything and this guy just collected his percentage.

    Who should I report this to? I need help. We are tired of companies taking advantage of us. I have a couple of previous carriers we were leased on to that have done these same things and I am ready to take action against all of them. I appreciate anyones help on this issue.

    Sounds like you need a Transportation Lawyer. They have the experience and know what they are doing.

    I am lost on this one. You leased to a guy and didn't even meet with him until after a month of running? You didn't know anything about the company or its operations until you met with him a month later? Did your husband even read the lease agreement? Since this has happen at previous companies I guess the answer would be "NO". Hopefully your next lease you do your homework and READ THE LEASE AGREEMENT.

    Well, since we are broke since they did not pay us (among past other companies), do you know any pro bono lawyers?

    Yes we did. He had a VP of Operations that we usually dealt with but he always claimed to not know too much. I was trying to get right to the point of my story. Someone that is intelligent should know that when you lease on to someone those are priority, it should not have to be explained. The owner was a driver himself.

    I am saying any smart person would know that we checked the comapny out; that should be a given and not assumed that we did not do our homework. We did read lease agreement. We did read all documentation. When you have a truck payment and bills to pay we did our best to work with this motor carrier.
