    A previously deported illegal immigrant is suing the federal government for injuries allegedly suffered at the U.S. Port of Entry at San Luis, Ariz., while being detained for trying to re-enter the country.

    Jose Gutierrez, 41, was hospitalized in Phoenix for a head injury after falling at the port on March 30, according the lawsuit filed in federal court in Los Angeles, where he resided before being deported.

    Gutierrez had been trying to re-enter the country through the San Luis port when he was referred to a secondary area for follow-up inspection, according to U.S. Customs and Border Protection. He fell and hit his head on the floor while trying to escape back to Mexico, the agency said.

    Gutierrez was taken to Yuma Regional Medical Center and then transferred to St. Joseph's Hospital in Phoenix, where he was in a coma for several days, alleges the lawsuit filed a month ago.

    no what IS sad is that he will most likely get some money. also, are you a ware that an illegal immigrant if he/she gets hurt on a job, they can get workman's comp..?? this does happen...they ain't even LEGAL HERE and they CAN GET MONEY..!!

    i too say, he should have fallen harder.....that's what's wrong with not just this country, but our politicians who are AFRAID to do or say ANYTHING in fear of upsetting the voters (of the same nationality as the illegals)....that vote them in..!!

    but he would have to pay into workers comp in order to collect it wouldnt he?
    i kinda thought they would be a cash basis
    but he was caught committing an illegal action--its too bad he fell --but to get money for it would be a crime in itself

    no in this case of the guy falling down, he may be able to collect money..from a lawsuit.

    in the case of the injured illegal worker, the company has workman's comp they already pay, and they DO GET IT...illegals get compensation..!!

    allthough all of people win BS cases like this, in this case i think this guy is SOL. He was an illegal trying to illegally enter the US and then tried to run away when caught. If he gets ANY money after he was taken care of here, we have some major problems!
