Bridge law under length? Never heard of such a thing!
No recap and less than 70? There is no rule, regulation, or law that requires you to keep up your recap....now a company might require it on specific designed logs...but where could you get a DOT/DMV citation for not keeping you recap?

A quote from the driver's sister.
"They were such a nice family..."
"He was such a quiet boy..."
"She was never violent..." -

Based on his record of previous speeding violations it isn't much of a stretch to assume he was already speeding, then when he saw the warning lights and/or train he thought he could beat it, but realized too late he wasn't going to make it.
This kind of thing is incredibly common and results in many crashes, fatal or otherwise, every year. -
in my career the dot has hit me THREE times w/ not doing recap as the only thing wrong w/ my logbook, and its listed as...
395.8
Log violation (general/form and manner
i was logging it as i did it,i was well under my 70 and it was obvious so i didnt need to add it up...
but i always do it now, just so they cant flag me for it. -

They found his cell phone yesterday and are now in the process of going through the records.
But the part about 300 feet of braking tire marks tells us all that he was doing nothing but hauling arse!
I wonder if anyone knows how the company has the trucks set?
My math bites so would someone figure out from his skid marks how fast he was going not to forget that he hit the train hard enough to explode and derail cars so he was still loaded with more than a little momentum when he hit. Add 10 MPH to the problem as he had to be doing more than 1MPH!
But most of us will say it. If he had survived the accident his next home would be the jail and it would be doubtful if he ever got out. Nothing but his fault all around even if the crossing was at a 45* angle all it takes is a lean forward and a look back! He had apparently been across that crossing enough times to know it was there so the point one made earlier that it was unexpected isn't worth the time to type it especially since the other drivers behind him wondered why he wasn't slowing down!
Where is the first R/R crossing sign? Anyone know? 1/2 mile before the tracks? -

In all the times i have seen these trucks, i passed them. I could only do 70, so they must be set at between 65 and 70. When loadd they are slower, especially on the upgrade.
