Just some of the stupid things I see

    A little off topic....

    But I've been thinking a lot lately about that....how we can be charged criminally when things go wrong, and most of the time the driver's log book is used against him/her in that criminal trial.

    You see, the Miranda warnings lie to you. The "right to remain silent" is nowhere to be found in the Constitution. What IS there, however, is in Amendment 5...

    So now let's take a look at the FMCSR...specifically §395.8:


    Sounds like the driver is COMPELLED to keep this record of duty status, which will then be used against him if/when he is charged criminally following a wreck....the driver is essentially being compelled to be a witness against himself.


    The way I see it, the state should either have to build their own case WITHOUT the use of that log book, or else the driver should not be charged criminally.




    ...ok, now that I got that out, what were we talking about again?:biggrin_2556:

    For once, I wholeheartedly agree with you.

    Just like as a USAF SP, when one of us got into trouble, we were just handed statement forms... never read our rights, etc... and we would make statements! Looking back on that, here we were protecting everyone's righst by offering Article 31 rights (like Miranda, just not as lenient)... but WE never took advantage of it when one of us screwed up. A bit arse-backwards.

    Our 5th amendment right isn't the only right we are expected to give up!!

    I believe I started a thread a long time ago detailing this and most everyone wanted to argue with or denigrate me for my posts!
