I have a felony for theft and misdemeanors - can I be a truck driver?

    Actually it's two problems. One you can't get violations, especially multiple violations through no fault of your own. And two you have failed to take personal responsibility for your actions.

    I can tell you if I decide to air my dirty laundry, and yes I have some, the first thing I will do is admit fault and take responsibility. I will not do this to avoid ridicule, I will do this because it is the right thing to do. I will do this because this is what I expect of others. I will do this because the first step to improving behavior is to admit your mistake and own it.

    Maybe I'm mistaken but I haven't seen a single person take a beating that has done this. The ones that don't do this do get hammered and rightly enough so.

    That's NOT what I was saying in my post. What I was saying is that you were criticizing that guy for asking for help.

    He was simply stating he had X violations and trying to explain his situation so someone who wanted to help would understand what issues he was bringing to the table.

    I was replying, stating that "why are they calling him a troll?" because he was airing his misfortunes and asking for help?

    If he would have simply said "hey can someone help me find a job?" The first thing truck drivers would have done was criticized him for NOT airing his details.

    I was simply stating that it is a catch 22 and that in the trucking world you will never find 2 drivers that agree on anything lol!:biggrin_25523:

    And as for my personal experiences which I alluded to "no fault of my own" was not me NOT taking responsibility, it was simply the circumstances.

    I'll air my laundry cause I don't particularly care :biggrin_255:

    I received an "Obstruction of Traffic" citation. It is considered by ALL companies to be a "Moving Violation". So it hits me when I apply.

    Circumstances, I was in a "state forest" on a paved road. I was sitting behind 2 vehicles which were waiting to make a left turn at a traffic light which was green. I was patiently waiting for my turn to make my left turn when the cars in front of me made there turns. The light was still green and when I let up on the clutch of my car it lunged forward and stalled. I was now sitting in the middle of the intersection and my car wouldn't start so before I created a huge situation by leaving my car in the middle of the intersection trying to figure out why it still wouldn't start after 2 or 3 times trying, I jumped out and was pushing it to the side of the road when a park ranger came along and instead of helping me asked me why I was running a RED light. I almost lost my mind and asked him if he was serious. He ticketed me and when I went to court the judge asked "where you obstructing traffic while you were removing your car from the intersection?" I had to answer honestly and the answer was "YES"....

    Second example. I was cited by the same officer in the same town for "Talking on a hand held device while driving" I wasn't driving at all. I had pulled over off the lightly traveled roadway and was sitting on the side of the road responding to an important text I had received from my family. I was in a hurry to check the message and respond so I quickly pulled off and put my car in neutral and pulled the emergency brake and grabbed my phone. Same park ranger pulled up behind me and I thought, here we go again. He cited me because he told me that my driver side rear tire was touching the white line and that I was in the road way which constituted as driving.....court again, was asked "were you sitting behind the steering wheel in your motor vehicle?" "YES" I replied, "were you not in the roadway?" "NO" I replied, "The officer states you were in the roadway." I replied, "There may have been an inch if that of my rear tire touching the white line but I was stopped with my hazards on." "The white line constitutes as the roadway son" so circumstances matter!!!!

    The speeding tickets I have gotten, well, I'M GUILTY OF THEM 100% I have a heavy foot, but I'm not unsafe, just fast LOL!!!! :biggrin_255:

    I think I'd be staying out of the state forest. Sounds like you have a Barney Fife on your hands. Most forest rangers have better things to do than play traffic cop and write bogus tickets.:biggrin_2556:

    I know what post you are talking about and it is easy to criticize others. The thing is I do my best to help others and have never criticized someone for asking for help or asking questions. My posts have offended not a single person I have been critical of that was truly seeking advice. In fact if you care to look, most if not all of the ones I have been candid with have either thanked me with the "thanks" button or in a post. I spend large amounts of time making sure my posts are constructive criticism, factual and to the point. I get several emails each week thanking me and/or asking for my help. I have angered a couple of posters with unrealistic expectations or those who failed to take responsibility. Unfortunately, you can't save the world.

    I call it like I see it and I don't pussyfoot around to preserve others feelings because I don't expect them to do that for me. I am a no ######## kind of guy. If you need help I'll give you the shirt off my back. If you do me wrong you had better sleep with one eye open.

    I stand on principals and values, I may not be right but I stand where I stand and I don't move to make my family, anyone else or myself comfortable or happy. When I break the law or make a mistake, I admit guilt. Now I fight all my tickets but as Americans we are given a system where we can do this. There is no reason, even if I'm guilty, that I should not have the most favorable outcome I can afford.

    Now if you fail to see fault in your two violations, I doubt I can help you there. The first one was unfortunate and ridiculous. Still your clutch operation killed the vehicle and it wouldn't start. Whose fault was it that you killed it? Who's fault was it that your vehicle wouldn't start? Now the second one takes the cake. As a professional driver you would park on a shoulder? How many deaths have you seen from this? But to park with your tire touching the line is a dangerous act. I hope you have learned to keep a low profile around this idiot in his forest.

    My advice to anyone pulling onto the shoulder is park in the ditch and get far away from the vehicle.

    I can't tell you how many bone-headed mistakes I have made in my life. I'm not going to air them on a public forum because I don't need help with them and I would expect to get hammered. I give the same advice I used to put my mistakes behind me. Take responsibility for your mistakes, cover them with a perspective employer, site the lessons learned and quickly move on to discuss your strengths and what you can offer this employer. For this I have always received forgiveness and respect. I personally would not hire a driver who told me he has two tickets through no fault of his own. The one thing you can count on with that mentality is that driver will get more of those same or like tickets.

    Far as I know, a deferred sentence counts as a conviction until you satisfy the conditions of probation. Once your done there's a chance that you won't be legally bound to even mention any of this. Ask your attorney, but as I understand it once it's all complete it's like it never happened. Only problem is that most companies also ask for arrests as well as convictions. Also ask your attorney about getting your record expunged. An expunged record removes anything that doesn't result in conviction and may even remove convictions after a certain time.

    Are they saying "conviction" out of their background check or what you're telling them? From their perspective, if you're on probation then you've been convicted. The deferred status doesn't mean anything to them.

    The background check is what I'm curious about. I don't know enough about where companies get them and what information is included. I've got a felony in my history as well and my idea is to simply match what I tell a company with what my background check says. Only problem is that background checks may not be the same coming from different companies.

    Your best bet is just tell the truth. Depending on the age and nature of your felony, you may be able to simply make sure it's mentioned on your application, where asked.

    Even "expunged" records have been known to turn up in the strangest of places.
