    OK, put away the temper and bring out the common sense. And don't ever put words in my mouth - I'm trying to help you out and encourage you, and will simply go away if you want to act like a jerk, as I have better things to do with my time.

    Read my post again. I didn't say you were less qualified than a felon. I said you were less qualified than someone with nothing in their criminal history.

    And to your last question, if it dodn't involve your employer or truck, meaning happening at a shipper or a terminal, probably wouldn't have any effect at all.

    Are you free of probation yet? That might be your problem. Most probations won't let you leave the state.

    There are drivers out there with just traffic violations that can't get hired. Companies have time frames on infractions. 3,5,7 and 10 are the lucky numbers depending on what it is and what company.

    You are innocent and plead guilty. That's is not normal activity and expect an employer to believe any different than what went down in court. You could of got an order of protection against the stalker and put him in jail. Words or harassment is not justification for an arse whoopin in the law's eye. Unless he got physical, you were wrong. You say you got punished for threatening to kill the guy? It's your word against his. Let me guess, you admitted to that too. How is it terrifying for your wife to see him in court? She didn't even have to go. You could of took a notorized statement with you. You handled the whole situation poorly.

    How are you going to protect your wife when you are on the road?

    I'm not sure of the time frame and each state is different. I think it's after a year you can go back before a judge and request an expungement. The judge will approve it and that record will be sealed. Nobody can see it but the courts.


    That might be the route you have to go. Do a google search on it. Then you don't have to reveal it to trucking companies, nor will they see it.

    I do appreciate the info Ronin. I just do not understand when you read requirements of one of these companies and it lists " no more than 3 tickets, one DUI, and one accident in 3 years, and I do not have any of those but do have one misdemeanor for which these companies mention nothing about, I wonder how I am not qualified. I am not trying to be a jerk. I just think if some of these companies had the courtesy to find out what actually happened and actually put themselves in my position at that time, maybe they might understand it a little more clearly. Instead, they have this holier-than-thou attitude like they lead some kind of perfect life just because they never were CAUGHT doing something wrong. I am not being confrontational at all. It is one thing to not get a job. It is another not to even be given the chance. Thanks for the assistance with all due respect.

    No, I was not innocent. I did exactly what I said and yes since my wife was a witness obviously, she would have to testify to what happened. Sure, I would have only needed 1 of 12 people to see it my way but I did what my attorney and wife thought I should do. In a simple assault, all you have to do is touch someone which my attorney told me it may be a difficult case to win. I sure a lot of people would have done far worse to this piece of sh** than I did. As for an order of protection, yea h that little piece of paper does a lot of good. I will never apologize for what I did to that little worm and I know that if put in the same position again, I would do at least as much. Thanks for the info CC. I respect your opinion.

    I didn't say you weren't qualified, I said you wee LESS qualified than the folks with NOTHING on their records. Meaning, a typical company selects applicants from the group with no record and a clean MVR FIRST, and then starts with other folks.

    I'm confused about the "legal discrimination" part. Most companies are afraid to hire someone with a criminal record.

    You may not have felt like a protection order would have been enough and it may have not been. Unfortunately, the law is the law. That doesn't mean I like it or agree with it, it is a flawed system for sure.

    Also, just a casual observation from reading your posts, you seem to be a bit hostile. I'll assume it is because you are upset about the job situation.

    I give a +1 for finding a smaller company to go with where you can talk one on one with the hiring manager.

    I never been married sub so I don't know. I'd probably done alot worse.

    Check on that job and expungement.

    trying getting your record espunged.Sometimes a letter to the judge explaining the problem will do it

    Discrimination IS LEGAL and necessary. There are a few groups/reasons you can't discrminate against someone, but otherwise it's legal. Replace the word "discrimination" with "choosing".

    The law isn't about logic or rightness, it's about the particular words in a particular law and the latest meaning of those words, nothing more. Why does it take 3 years to complete law school, because it's complicated and you have to learn new ways to think and where to research. If it was just feeling what was right and wrong they would hand out law degrees at every truck stop and barber shop in the country. They don't.
