How to Refuse a Police Search (USA only)

    Sorry, it does apply. Would you agree that it may be excessive to charge someone with a clearly circumstantial violation due to an existing condition? How far do you wanna take it?

    Now this is interesting, many officers try to intimidate, coerce, and trick people into giving up their Constitutional Rights (see original video).

    However, when their rights are subject to violation... Enforcement Officers immerse themselves in Constitutional Law.

    on the white sheets I asked DOT last week on this very subject. he pulled it up on his laptop and it states you must have adequate bedding as to be livable and reasonable.

    I was always told they required white also.

    Well when people interpret laws differently about the only way to come to a resolution is through a 3rd party, like a court. That's what their job is. We could continue to go back and forth on this, and be no farther 12 months from now than we are now. So you believe your interpretation, and I encourage you to use it if you get hammered by DOT.

    So they are not privileged to the same protections as all other citizens? That's what you seem to imply.

    LEO's are people, not saints, there's bad apples, corruption just like any other political entity. That does not make all of them bad.

    Yup, we must agree to disagree.

    Truck drivers don't receive the same protections as all other citizens. (ie No expectation of privacy in a place they could clearly be living in...(the sleeper). Why should enforcers play both sides of the fence?

    I know not all LEO's are bad(I come from a family of them, and have many friends that are cops). However, I have seen a pattern develop around the more experienced one's. In a sense, they start having a mindset that all people are crimminals, or violate the law. Truth is, most people are hard working and just trying to live their American dream and be happy.

    FWIW, I've had candid conversations about this with a state trooper friend of mine. As a good apple, he has said to me. I cannot understand, other state troopers pulling vehicles over for going 10-15MPH over the speed limit. The trooper said, "Heck, I'm way to busy pulling vehicles over going 30/40/50 MPH over the posted limit".

    I have dealt with reasonable, honest cops and complete butt holes before. There are ones who are going to be bullies and abuse their authority, and there are ones who are regular people like us who are just doing their job. These guys see people get their organs smeared on the asphalt just because they weren't wearing a seat belt, or safe drivers get killed because someone was sleep deprived or on drugs. Think about how much crap they have to put up with and give them a break. You might be surprised how far being courteous and reasonable goes. A lot of the time they are just happy enough that someone isn't screaming at them that they will just let you go. The pricks, well, you can always get their badge number and report them. ^_^

    If I think back to all the cops and all the truck drivers I have ever met and think about what percentage of them are arseholes, the bigger percentage is truck drivers by a huge margin.

    Yeah good point there's good and bad 1's in every trade. Hey i hear Rowin Atkins has a new Johny English movie out.

    The police will and can search you with probable cause. Probable cause is discretionary and most usually can be justified in a police report. Refusing to a search will raise a red flag and cause for further investigation. Further investigation can mean a whole bunch of options the police can use justifiably by law.

    If your law abiding and have no worries, then let them do their job. They'll be out of there quickly. If your are hiding something and you put up an argument, I guarantee you they will find a lawful way to search at a very inconvenient cost to you.

    Not worth the challenge just because you don't like the law.

    Not liking the law and having your personal freedoms trampled on are two different things. We may as well be living in a Police State the way the lawmen interpret the law anymore. So if I don't consent to a search it automaticly means I have something to hide? Maybe I just don't want strangers pawing through my stuff. The police act more like the Gestapo. And heaven forbid you don't just bend over and comply. And God help you if you have an idea of what your rights are, you're public enemy #1 then. Capable of creating all sorts of mayhem. I will always question Authority and I will never go quietly.

    I've said it before and I'll say it again... "What an agency may call 'security', others may call 'oppression'."

    If it goes far enough, people may take up arms. After all, the Constitutional right to bare arms has nothing to do with hunting or personal protection. It has to do with the right to protect yourself from a oppressive government.... (much to the dismay of the powers that be...)
