I had posted another thread and you guys gave me a lot so I will throw this one out there to you. I have a clean 10 year MVR nothing on it at all. I was trying to go thru Schneider to get my CDL. Here is my issue. In June of this year I was taking a kid in the church home when he went into a full blown seizure. I was 1.8 miles from a hospital when this happened. I ran 2 red lights to get him there asap. A SC state trooper saw me and followed me to the hospital (no blue lights). We got the kid out of the car and they took him straight to the back. The trooper said that it didn't matter that there was a medical emergency I am not able to run red lights no matter that I checked both ways or not or if there was an medical issue. He gave me a 6 point ticket and charged me with wreckless driving and a 200.00 fine.
Well I called and talked to a friend of mine on the local force and he contacted the state trooper. They just called me and said that what he will do is have me go to court and ask for a jury trial. They then will reduce it to something less that won't screw up my CDL training before the trial. This will take about 2 months to do. Schneider just told me to call them when all that goes away because they can't have anything pending when I am hired. I called Maverick who I was also dealing with and they said it was not a problem since my MVR is clean and said they would call me in the morning after they looked at my App. I had sent them. I told him that it would be about 2 months before it was all said and done.
My question is am I screwed. They said they will reduce it to like a illegal lane change and 2 points or speeding with 2 points. Should I push now harder to go with Maverick if they will have me or what. I need you guys to advise me. Maverick said that it will be at least 2 months before they can send me to a school because they are that busy (unless someone canceled). I wait to hear what you think!

^ The Problem is with that is I am self employed. Work in my business goes away in about 1 month (fall) that is why I had planned to go to the school now! I was going to sub out my accounts to someone els when work comes back around in the spring so i can still keep both. I would sell my business to the other guy if I decided that I didn't ever want to go back to it.

Do not be talking to cops about how to handle this. They are full of BS on this. You do not get a jury trial for a traffic ticket in any jusrisdiction I have ever heard of. You get either an informal hearing or a formal hearing. This is important to your career. GO SEE A LAWYER! Have the lawyer handle it. If your facts can be verified it should probably get it thrown out, not just reduced. Do not take legal advice from cops or friends or anyone but a lawyer. These people are not licensed to practice law and should not be dispensing advice. GET A LAWYER!

^ Thanks. I will tell you in this county when you go to the court date you can ask for a bench trial or a jury trial. If you go to a jury trial they will do a pre trial first before it ever gets to a jury so you can try to settle it. If you do a bench trial then the judge does it right there. My police friend called and spoke to the SP and he said that it was OK with him to reduce it but we would have to wait for the pre trial so the solicitors office can authorize it so it won't look bad on him for rewriting the ticket. As far as proof I have all my ducks in a row on that one.

Where are you located? I was a lawyer for 12 years and never, ever heard of any state that offers jury trials for traffic tickets. Was this a misdomeanor charge? I still say call a lawyer. You would ruin your future career just to save a few hndred bucks. None of what you're being told sound right to me.

I have lived in Greenville, SC now for 30 years next month. Heck I can't argue about any were els because I have never lived any were els. Lets say I did call a lawyer how long will that take for them to fix the issue?

I was a Police Officer for 7 years.... I agree with the other advise you've been given.. Get a lawyer... I know its expensive.. but its no sweat off the cops neck if you are charged and subsequently found guilty as charged.. He'll just say "I tired"....
BTW as an x-cop, I'd say the guy is a real jerk to give you the citations in the first place. There is a difference between the letter of the law and the intent of the law, however it will take a lawyer to present that case for you. With your future as a driver on the line.. the lawyer is a must. -
How long would all that take and how much would you think that all that will cost? I was also told by my police friend that he was training a guy that day and that may have had a lot to do with it as well.

Find someone who has a good working relationship with the solicitor and they may be able to solve this with just a phone call, maybe a letter. With your facts, they may be able to get it thrown right out or reduced with just a call or letter. If not they might be able to get a "Pre-Trial Defferment", which means that they set the charge asside for some period of time (usually a 6 months or a year) and if you have no other tickets, it's gone. I don't know if SC has pre-trial defferment or not. If none of these work, go to whatever the highest evel of hearing or trial you can get in SC, however I doubt that is a jury, unless this rises to misdomeanor status. If it goes to a trial, pul out the stops. Get testimony or affidavits from everyone at the hospital and put the kid on the stand and his parents. Make sure they cry and impassionately declare that he would have died if not for you and how you were SOOO careful getting to the hospital, even though you sped and ran the lights. Tell how you slowed and checked for trafic, were alert and on top of the situation. I predict this is settled without the need for any of this, but if not, make sure that the lawyer gets all these impassioned affidavits in advance and the solicitor sees them all. The solicitor would be crazy to go to trial in the face of these facts.
Step one, call the lawyer. I suggest you ask around about who handles lots of these and is chummy with the solicitor. Start by asking your cop buddies and follow up by asking around the clerks at the court. They know who's god at these and who isn't
