We are a small trucking company. We did a load for JB Hunt, picking up at Diamond Crystal salt facility in Savannah, GA and delivering to Sysco in VA. Driver spent 8.5 hours at the Diamond Crystal facility getting loaded.
Driver called JB Hunt and verified that we will be reimbursed for the 6.5 hours detention. The condition was that time in and time out was supposed to be recorded on the BOL. Diamond Crystal shipping department has a detention form that they filled out and gave to the driver. The form had time in, time out and all necessary information. If also had a big Diamong Crystal header on it and stated that this is a "detention form".
JB Hunt refused to pay detention based on the fact that they asked the time in and time out to be stated on the BOL and we gave them a separate form, which was given to the driver at the same time as the BOL and he actually assumed that this was part of the BOL.
I can understand some schmuck company trying to get away from paying based on this type of BS, but I really didn't expect this from JB Hunt. When I asked to talk to a supervisor, I was transfered to a voicemail and of course the call was never returned.
I filed a complaint with Internet Truckstop. Let's see if they can resolve this. I hope JB Hunt doesn't think that this issue will end just like this. They will spend a lot more money than they owe us in legal fees.

No offense, but if you don't submit the paperwork required why should a company pay you? The contract stated the times must be on the BOL, why did you not simply have the driver add the times to the BOL then?
Why is this an "evil JB Hunt screwed me!" instead of an "I screwed up, make sure you actually read and follow your contracts!" thread?

Because driver is not a laywer. Driver did not screw up. Driver was given paperwork from the shipper. BOL and detention forms were all in one pack. Driver assumed that the detention form IS part of the BOL and he had no reason to think differently. In fact, the shipper has a stamp on the BOL itself. Nowhere on the stamp is there a space to put time in and time out. That, according to the shipper, is what the form is for.
What I really don't understand is that the shipper is perfectly willing to pay the detention. Why would JB Hunt refuse to pay it to us? Driver did a perfect job for this shipper. He waited 6.5 extra hours AND delivered the freight on time. What does it matter how the time in/time out is recorded, if everyone agrees that the detention actually did happen? -

Seems to be a common practice that crosses many lines...........I was speaking with our billing gal on another matter and she eluded to this frustration. Customers kicking bills because the dot is missing off the eye or the tee is not crossed. But really, it was about missing truck numbers, trailer numbers, blurred signatures etc. Just small details that don't affect the actual move.
She figures if a shipper can hold 100k in payments for 30 days then they have done good. I asked why she didn't freeze the credit and she said mgmt. won't allow it.
I say give them a little room and then nail their arse if they still won't pay.

It's called procedures. If you assume and can't follow them, that gives them an excuse to beat you.
Your exact words.... the time in and time out to be stated on the BOL.

I use to haul Tyson. Damage claims you had to get all the numbers off the box, call OS&D and after the procedures, you were issued a claim number and then could dispose of the stuff in various ways.
I had one stop at a Tyson plant, dropped the trailer sealed and picked it up sealed. Went to 2nd drop at around 3am on a Saturday. Opened the doors. Two boxes of fat were busted all over the ground where the previous stop tossed two boxes up on the edge of the last pallets.
I got all numbers and called my weekend dispatcher, no answer. Called Tyson OS&D. No answer, got voice mail, so I left info. Hmmmm, what to do?? I took pictures, cut the info off of the destroyed boxes, cleaned the mess up and threw it all in the dumpster because it was just fat that got contaminated on the dirty floor. I got unloaded and proceded to my last drop.
By then it was 7am, I called Tyson back and reported the OS&D again. Because I didn't save the ripped apart boxes, I had to pay like $160 for them out of my pocket even though I had all the numbers and pictures.
Follow procedures exactly!
You take some moron behind a desk, that works all day like a robot gov't employee, they tend to get pissed off when someone doesn't follow procedures. Don't follow, you messed up their day and they will seek revenge. -
Well before ya start trying to collect money make sure ya got what Diamond Crystal makes correct first. I live 5 miles from the plant. And its SUGAR. Not salt.

I just assumed it was salt because I'm used to seeing diamond crystal salt in grocery stores. Either way, sugar or salt, makes no difference in what actually happened.

good luck at getting jb to pay anything...they told you how they wanted it...you should have had it stamped on the bills like they asked...
