Has this happened to you? Can the bears do this??

    Yes, they have thirty days to file summary citations (traffic or non-traffic). Most officers, not all, wait until the investigation is complete and then file the citation via mail instead of issuing it at the scene. Theres enough to do at the scene as it is. It sounds like you weren't going to be cited at all until "the boss" reviewed the report and recommended it. If the officers at the scene didnt feel strongly about citing you, they may feel the same way come court time and it could work out to your benefit. Good luck.

    I got a ticket for running a stop sign in PA. 28 days AFTER I was there! Turns out a citizen called in with all my truck info stating that I did not stop at the stop sign on "whatever road" and she was concerned as that is a very small road for such a large truck. Without ever talking to the police, courts, etc, I received a ticket in the mail. (citizan has 30 days to file for a citation to be issued) After getting the ticket I called and spoke to the officer who wrote the ticket. He ADMITTED there isn't even a stop sign on that stretch but since they received a request of citation from a PA citizen then one had to be issued. Of course I could fight it and the officer agreed I should. But to fight it I would have missed 3 days of work, AND it would cost me $90 more then the original ticket. He agreed to change the ticket to improper parking, I paid a small fee, and never delivered to Huntingdon Pa again. Total BS laws out there. BTW- that officer just happened to be DOT, he said that states will often do this to truckers because they know we don't have time to fight it so therefore we pay up and move on. Kinda like I did...shame. I hope my little incident helps you...

    I have a friend who also lives in PA. He had someone call in to the cops about something in a construction zone. It sounded like BS to me. He got a call from the cops and received a citation in the mail. Rather than fight it he paid the ticket. I tried to get him to fight the ticket, but he decided to not do it because of taking time away from work. It nearly caused him some problems with the carrier to whom he is leased by paying it. I don't think that a citation should be issued unless the officer witnesses the offense. The individual could have a vendetta against the company or trucks in general.

    I agree, the office should and MUST be there to witness the offense. For all I know the person that reported me may have felt (personally) that big trucks should not be allowed to travel that particular road, therefore calling in a made-up violation on me. It's a total BS law they have going on in PA. I live in a commonwealth like PA (VA) but we don't have crazy unjust laws like that on the books....well, not that I know of and I've lived here for 35 yrs. Idk...PA has some pretty screwed up law IMO. But, I've got some pretty good paying loads going in and coming out of there so...what can ya do, right? :biggrin_2552:

    I received a speeding warning, along with tickets for no IFTA sticker, and no inspection sticker. When I went to court to fight the tickets, the prosecutor upped the warning to a real ticket, because I was contesting the tickets. Things happen!

    Things such as this are only about the money. Prosecuters will often raise the charges in anticipation of the defendent agreeing to a deal which gives the prosecutor the conviction that he wanted in the first place. It is criminal what some of these cops, prosecutors and judges are doing in order to raise revenue. It seems that more and more we see the government doing things that are questionable at the least and criminal at the worst.

    You know you do not have to be there to fight the ticket. I recently got a bs speeding ticket in TX and a lawyer down there is representing me and will appear in court on my behalf should it go that far.

    I have lived in PA for the better part of my life and we have some of the most messed up laws around.

    When I was in high school I was in a bad accident. I was driving and don't remember what happened, but my '81 dodge omni got ripped in half vs a minivan. While in the ER with my parents the cop was dumb enough to ask my father why he let me drink before driving (I wasn't drinking). Pops almost went to jail that night but it would have been a very short trip to the er for the officer...anyway a week later I get a ticket for doing 81mph in a 45. First off that car couldn't do 81mph down a mineshaft, and definitely not on that winding back road. Hired a lawyer and made that cop look like an ### getting to use him assuming I was drinking to point out that he assumed other facts not in evidence. My lawyer ripped him apart then asked him on the stand when he got his accident reconstruction training....he was never trained for accident reconstruction.

    Fight it, I would.

    This is so not true. An officer can take into consideration any witness to a crime/offense in whether to arrest/issue a citation.
