OK, now for any of you reactionaries, just calm down and hear me out before you make an assumption.
I am in the habit of having one drink, and only one, before I go to bed each night. Just a little nightcap to help me sleep. Is there any law against having a bottle of liquor in the sleeper? Is it feasible to have a shot right before your 10 hour rest period or is this just asking for trouble?

My main concern would be having 'alcohol' on my breath and being woken up by the cops for a 'variety' of reasons---sleeping on a ramp, somebody hits 'YOU!,' and the one time I got paranoid, having to move my rig when parked at my parents house (for the night) on the edge of suburbia (had 2 glasses of wine with spaghetti dinner that mom cooked!). Hi-anxiety til I found a shopping center to park it at!!

jamwadmag has a very valid point. The regulations clearly state that no driver shall use alcohol, or have any measured alcohol concentration or detected presence of alcohol while on duty, or operating, or in the physical control of a CMV.

You WILL be busted, you WILL be put out of service for 24 hrs, your company WILL be called and there is a real good chance you WILL be given a breathalyser test. All this for simple possession.

Not necesarily. I got a ticket in Arizona several years ago for having beer on my truck. Although the ASP didn't believe my story that it wasn't mine, that it had been left by someone else, I was never given a BAC test because the ASP Officer said it was obvious I hadn't been drinking. I WAS put OOS for 24h, I DID get a ticket for Possession of Alcohol in a CMV (minor infraction) and I DID lose my job (violating Company Policy)
But "OPEN Container" is a different thing altogether. OC in Michigan is 6 points. Truthfully, you CAN be ticketed for having Nyquil or even mouthwash containing alcohol. -
