That's your choice. But if you're not willing to bend on that, then I would recommend you get out the business. Because if the situation were reversed, they would not hesitate to sue you.

i think if i was in your situation i would look for a new company to lease onto hauling frac sand, you have already made the investment for the truck and the blower. from what i hear there is decent money in hauling sand.

I would advise them that your legal document "the lease" says 625 a week and you would highly suggest they refund your over payments.
Their financial bind is not your problem. ....Call a lawyer. -
Sylvester services did refund what I spent on the hoses for their trailer, $2500 they charged me for the trailer the week they changed contract. I never got the change in writing. I just showed up to get my check and I had $2500 taken out not the $625 the contract stated. As this was sure not my first red flag it was time to bounce. More than one thing changed without notice.
This thread is old now and I have just put this behind me. I'm glad for the advice but this thread was really just to warn other drivers. -

Thanks, you did not offend me (what in a name). The situation has been resolved. They did not like the bad press. They are still suckering drivers in all the time....poor saps. Most guys from my area know to stay away now they are getting drivers that were just fired from the PA patch I think. But I'm moving on now I had an interview today I have two tomorrow and one Friday. I think I might even lease my Pete on the one company and hot shot out to the oil rigs with my daully.
I was very worried for a bit because I got behind on my bills but even that deal is alright now. I have three boys under the age of four and most of the job offers were OTR and I made up my mind to be close to home, which the frac. hauling is for me. Now I have an offer with one frac company, one hauling band equipment(OTR), one with a scrape metal company(last choice), one using the Pete as a lease and then hot-shotting with the dually and then the last is going in with a broker that has lots of freight that wants into the carrier side with this one I would haul golf carts one way (great per mile) and then cars one the way back.
So i just got worried but had not fully "put myself out there" when i did things (my options) got better real quick!

Dot do it man!!! Don't go drive for ol' JB! They will suck you dry. Listen, you and I are in close to the same boat. Here's the deal. You have a truck and a blower, but no trailer, right? Well me two, except I have TWO trucks and TWO blowers, and NO trailers! That's aparently the hard part. There are plenty of frac sand jobs, you just have to know where to look. BUT in order to get one of these said jobs, you must have or lease your own trailer. And here's what I'm finding out. 1) Decent trailers can be found if you have the cash. 2) trailers for lease in Texas can be found. BUT you have to be in the right place at the right time. i.e. when the come avaliable. The key is to keep looking.
You sound like a hardworking, determined kinda guy. And I would really hate to see you just up and fold. Here are a few companies to call and research: Flex Frac Logistics, Trican, Tutle and Tutle (I am in the process of leasing on with them...if i can find two trailers for lease.), Vertex Solutions, Fazt Logistics, DnT.

Thanks JMHOPE I have contacted most of these companies and i will have to say Tutle is the one I'd like to go with. Do they have trailers?

If everyone I've talked to around Texas buys a sand trailer and goes to work those rates are bound to go in the crapper. Just my opinion but I know a few O/O around this state and I think everyone of them (me included) has at least mentioned doing it. I don't claim to be an expert in the frac sand field at all, just the opposite, but it sure seems like that market is getting a lot of players in it which is bound to push rates down. Just an example, I saw two Spirit trucks in Three Rivers pulling sand trailers. Guess they figured to park those vans and haul some sand while the getting was good.
