Drvrtch77 I think its legal to sublease to drivers. It's in a contract drawn up by lawyer's so it must be legal. I bet I can drive on over to penske right now here in Richmond VA, walk in and lease a tractor under their authority and they pay the maintenance on it not me. I believe maintenance comes standard with the lease. Like if you rent a truck to move.

@bigrin 25523 nobody is entitled to anything in this life. When a business fails because it was rigged from the start how is that the drivers fault. Sure blame the driver. Ya know I'm starting to think a lot of these dudes on here are in the lease scam business....yea that's right scaaaaam ( in my Jon Lovitz voice)

The company I'm leased on to won't allow the o/o drivers to get a dedicated run. They consider that forced dispatch. If you are forced dispatch then according to the IRS you are no longer an independent contrator, you are an employee. If a company doesn't adjust the fuel surcharge to keep in line with changing fuel cost you will not be able to stay in business for very long if you are receiving a contract flat rate per mile. Anyone who has been in trucking very long knows that fuel is your number one cost, if you can cut that cost by even a half gallon per mile your profits can increase by as much as ten thousand a year or more.
I'm not defending any company, I'm just saying if you are going to go down the road of running your own business you have to think of yourself first. Your first responsibilty is to your business, not the company you lease to. If you aren't making money then you need to make the changes necessary to turn a profit. You will make dispatchers angry when you turn down unprofitable loads, but if you aren't turning a profit you will be out of business very quickly. Honestly, this sounds like a company I would never have considered pulling freight for. -

@ bigdogpile I read the fine print. There is nothing In the contract that specifies any malfeasance. Or anything that would be considered unusual in a standard contract. Now having said that, there is something wrong with dispatchers arbitrarily forcing you to take loads. This is not In the contract. So why would it be considered my fault if the leases is a premature failure? Especially when the lease is rigged from the start. Of course your not going to find anything wrong in the contract.

Very good preacher man. As in my other comments I recognized I was a glorified company driver. Also the rate was non negotiable. So it didn't take long for me to make the decision to leave. 30 days. I am now a company driver making good money with a small company with about 29 trucks. Life goes on.

at least you are out of that lease nightmare.of course they play games with you because you are an indentured slave to them on a lease..You should of told them my lease doesnt say I'm forced to take a load..Ok then they make you sit...I offered up my own contract to a company stating they will pay me for ALL my on-duty time ...they said no , I said go find some other clown I 'm not the one
